r SCOPE OF WORK <br /> The prime contractor agrees further to release retainage payments to each <br /> subcontractor within 30 days after the subcontractor's work is satisfactorily <br /> completed. Any delay or postponement of payment from the above referenced time <br /> frame may occur only for good cause following written approval of the City of Santa <br /> Ana. This clause applies to both DBE and non-DBE subcontractors. <br /> Bidder shall list the name and location of the place of business of each <br /> Subcontractor who will be a supplier/perform work for the bidder in an amount in <br /> excess of one-half of one percent of the bidder's total Purchase Order cost. The <br /> Subcontractor list shall be submitted with the bidder's bid. <br /> Contractor shall indemnify, defend, and hold harmless the Agency and its <br /> employees and agents from any and all liability arising or resulting from the <br /> employment of any subcontractors and their employees in the same manner as for <br /> Contractor's own employees. <br /> 1.4 EMERGENCY INFORMATION <br /> The names, addresses and telephone numbers of the Contractor and <br /> Subcontractors, or their representatives, shall be filed with the Engineer and the <br /> City Police and Fire Departments prior to beginning work. <br /> 1.5 GUARANTEE <br /> The Prime Contractor shall be responsible for and shall repair any defects due to <br /> faulty labor or materials, which may arise or be discovered in accordance to the <br /> Standard Specifications <br /> 1.6 MARKUP <br /> This section shall apply to Subsections 7-4.3 of the Standard Specifications and <br /> these Special Provisions. <br /> A. Work by Contractor. The following percentages shall be added to the <br /> Contractor's costs and shall constitute the markup for all overhead and profits: <br /> 1) Labor................................................................................20 <br /> 2) Materials...........................................................................15 <br /> 3) Equipment Rental........................................................................15 <br /> 4) Other Items and Expenditures................................................15 <br /> To the sum of the costs and markups provided for in this subsection, 1 percent shall <br /> be added as compensation for bonding. <br /> B. Work by Subcontractor. When all or any part of the extra work is performed by <br /> a Subcontractor, the markup established in 1.6(A) shall be applied to the <br /> Subcontractor's actual cost of such work. A markup of 10 percent on the first$5,000 <br /> of the subcontracted portion of the extra work and a markup of 5 percent on work <br /> added in excess of $5,000 of the subcontracted portion of the extra work may be <br /> added by the Contractor. <br /> City of Santa Ana Page 5 of 71 <br />
