When it shall be determined to be in the public interest <br />for employees to perform overtime work, or in an emergency situation, the City Manager, <br />the Department Head, or a duly authorized representative of the City Manager or the <br />Department Head, may require an employee to perform overtime work. <br /> Definition. Overtime work for those on a 5/40 work schedule is defined as: <br />A. That authorized or required time worked in excess of the normal workday, tour of <br />duty, or workweek schedule for the particular classification and organizational unit <br />of an employee. A workweek is a fixed and regularly recurring period of one <br />hundred sixty-eight (168) consecutive hours –seven (7) consecutive twenty-four <br />(24) hour periods - as designated by the appointing authority. An employee’s work <br />schedule within the workweek shall not be changed to avoid payment of overtime; <br />provided, however, nothing shall abridge management’s right to establish and <br />change work schedules and assignments in accordance with the rights of <br />management contained in Article XIX. <br />B. Work on observed holidays or work on any regularly scheduled non-work day of <br />which there shall be two (2) per week, if work on any regularly scheduled non-work <br />day is worked at management’s direction. <br />Computation of Forty (40) Hour Workweek. In computing the forty (40) hour workweek, <br />the following type of work hours shall be included in the computation: actual work time, <br />jury/witness leave, and bereavement leave. Any combination of these work hours in excess <br />of eight (8) hours per day (except for employees on a 4/10 or the 9/80 work schedule) or <br />forty (40) hours per week shall entitle the employee to overtime compensation. <br />Paid time off for vacation leave, all unpaid leave, Association release time and <br />compensatory time off shall not be credited towards the forty (40) hour workweek. No <br />employee shall work overtime hours unless authorized by the department head or their <br />designee. <br /> FLSA Overtime All FLSA nonexempt employees working under the “9/80” work schedule <br />shall earn overtime for all hours worked after the first forty (40) hours in a FLSA work <br />week as required under FLSA. Should the City modify the manner by which it pays <br />overtime (FLSA) to members of other miscellaneous bargaining units, CASA agrees to <br />reopen this topic for discussion. <br /> Compensation for Overtime. <br />7.1 <br />7 .2 <br />7.3 <br />7.4
