Fourth Street) <br />RECOMMENDED ACTIONS <br />1.Adopt a resolution approving Conditional Use Permit No. 2025-18 for the sale of <br />beer and wine for on-premises consumption as conditioned; and <br />2.Adopt a resolution approving Conditional Use Permit No. 2025-19 for after-hours <br />operation as conditioned. <br />EXECUTIVE SUMMARY <br />Alexa Garcia with IG Drafting and Design, representing Tacos Los Cholos (“Applicant”) <br />and QOZB III, LLC. (“Property Owner”), is requesting approval of Conditional Use Permit <br />(CUP) No. 2025-18 to allow the sale of beer and wine for on-premises consumption <br />through a Type-41 license from the Department of Alcoholic Beverage Control (ABC) and <br />CUP No. 2025-19 to allow after-hours operation at the proposed eating establishment <br />located at 113 E. Fourth Street (“Project”). Pursuant to Sections 41-196 and 41-2007 of <br />the Santa Ana Municipal Code (SAMC) and Table 2A of Division 2 of the Transit Zoning <br />Code / Specific Development No. 84 (SD-84), establishments wishing to sell alcoholic <br />beverages for on-premises consumption and operate after midnight require review and <br />approval of a CUP by the Planning Commission. Staff is recommending approval of the <br />Applicant’s request because the site is located within a mixed-use development that <br />accommodates both commercial and residential uses, creating an environment where <br />such uses are compatible and supported by one another. Furthermore, the Project is <br />consistent with the goals and policies of the General Plan and will contribute to the <br />economic growth and fiscal stability of the City. Lastly, applicable operational standards <br />and proposed conditions of approval will ensure that the sale of beer and wine and after- <br />hours operation at the subject site will not negatively impact the surrounding community. <br />DISCUSSION <br />Project Description <br />Tacos Los Cholos will occupy an existing 3,093-square-foot tenant space on the ground <br />floor of the Rafferty mixed-use development, located at the northwest corner of Fourth <br />Street and Bush Street.
