<br />Resolution No. 2025-XX <br />Page 2 of 11 <br />include vehicular and pedestrian circulation, installation of new trash <br />enclosures, improved landscaping, and perimeter fencing. <br /> <br />F. On September 22, 2025, the Applicant submitted to the City an application <br />for a CUP (CUP No. 2025-22), requesting approval to establish a <br />professional school use in the existing buildings with minor building infilling <br />and alterations for egress; <br /> <br />G. On November 10, 2025, the Planning Commission held a duly noticed <br />public hearing for the Project; <br /> <br />H. The Planning Commission determines that the following findings, which <br />must be established in order to grant this CUP pursuant to SAMC Section <br />41-638, have been established for CUP No. 2025-22 to establish a <br />professional school use in the existing buildings within the P zoning district <br />as follows: <br /> <br />1. That the proposed use will provide a service or facility which will <br />contribute to the general well-being of the neighborhood or the <br />community. <br /> <br />The proposed school operations represent a professional <br />educational and employment-based training program. A <br />significant portion of the program occurs off -campus in <br />professional workplaces, under a federally regulated work-study <br />arrangement, and involves employer oversight and <br />compensation mechanisms that are not characteristic of a <br />traditional secondary educational facility. While Cristo Rey <br />provides academic instruction consistent with secondary <br />education standards, the integral and regulated employment <br />component, including formal employer-employee relationships, <br />wage tracking, and compliance with DOL requirements, <br />constitutes a distinct operational model that blends educational <br />and workforce development functions. Given the hybrid structure <br />of the program and the specific regulatory framework governing <br />the work study program component, the proposed use qualifies <br />for application as a professional school. Accordingly, the use is <br />classified as a professional school, consistent with the purpose <br />and intent of the Professional (P) zoning district, which supports <br />education, training, and business-related activities that prepare <br />individuals for professional careers. <br /> <br />The Project is compatible with the surrounding bu siness park, <br />which consists primarily of office and professional service uses. <br />By reusing existing office space, the school use is consistent with <br />the established architectural character, operational intensity, and <br />overall professional environment of the area. The educational use <br />will complement existing tenants by introducing a <br />community‑serving function while maintaining the professional <br />
