<br /> <br />Resolution No. 2025-36 <br />Page 2 of 14 <br />required businesses requiring a regional, state, or federal permit to handle, <br />store, emit or discharge regulated compounds, materials, chemicals, or <br />substances within 500 linear feet of a public park, school (K-12), or <br />residential zones, to obtain a conditional use permit. <br />D. Subsequently, on February 7, 2023, the City Council adopted a standard <br />ordinance (Zoning Ordinance Amendment No. 2022-03 and Ordinance No. <br />NS-3038) establishing the requirement to require a CUP for businesses <br />requiring a regional, state, or federal permit to handle, store, emit or <br />discharge regulated compounds, materials, chemicals, or substances within <br />500 linear feet of a public park, school (K-12), or residential zones. <br />E. On June 20, 2023, the City Council adopted Zoning Ordinance Amendment <br />No. 2023-01 (Ordinance No. NS-3044) amending Section 41-199.4 of the <br />SAMC expanding the separation requirement from 500 linear feet to 1,000 <br />linear feet. <br />F. The proposed service station requires a regional, state or federal permit to <br />handle, store, emit, or discharge regulated compounds, materials, <br />chemicals, or substances and is located 1,000 feet of residentially zoned <br />property. Therefore, a Conditional Use Permit is required pursuant to <br />Section 41-199.4 (Noxious Uses) of the SAMC. <br />G. On December 8, 2025, the Planning Commission held a duly noticed public <br />hearing for Conditional Use Permit No. 2025-03. <br />H. The Planning Commission of the City of Santa Ana has determined that the <br />following findings, which must be established in order to grant a CUP <br />pursuant to Section 41-638 of the SAMC, have been established for CUP <br />No. 2025-03 to allow a land use that requires a regional, state, or federal <br />permit to handle, store, emit or discharge regulated compounds, materials, <br />chemicals, or substances within 1,000 linear feet of a public park, school <br />(K-12) or residential zones. <br />1. That the proposed use will provide a service or facility which will <br />contribute to the general well being of the neighborhood or community. <br />The proposed convenience store and service station will <br />provide a valuable neighborhood-serving amenity to residents, <br />employees, students, and visitors in the surrounding area. The <br />Project will revitalize an existing outdated commercial site with <br />a modern, well-designed development that enhances the visual <br />quality and functionality of the property. The new buildings are <br />designed to activate the street frontage and improve the <br />appearance of this prominent intersection at McFadden Avenue <br />and Fairview Street. The Project’s contemporary architecture, <br />along with proposed landscaping, façade enhancements, and <br />improved on-site circulation, will create a safer, more <br />attractive, and pedestrian-friendly environment.
