Said <br /> policy or policies shall also contain a provision that no termination, <br /> cancellation or change of coverage of insured or additional insured shall be <br /> effective until after thirty (30) business days' notice has been given in <br /> writing to the City. <br /> b. The Union shall provide the City with an insurance carrier certifying that it <br /> carries primary workers' compensation insurance on behalf of said union <br /> representative and the policy shall not be canceled nor coverage reduced <br /> until after ten (10) business days' notice has been given in writing to the <br /> City. <br /> 3. Indemnity Clause <br /> The Union shall indemnify and save harmless the City, its officers and <br /> employees from and against any and all damage to property or injuries to or <br /> death of any person or persons, including property and employees or agents to <br /> the City. The Union shall defend, indemnify, and save harmless the City, its <br /> officers and employees from any kind and all claims to demands, suits, actions <br /> or proceedings of any kind or nature, including, but not by way of limitations, <br /> workers' compensation claims, resulting from or arising out of the negligent <br /> acts, errors, or omissions, arising out of the intentional or malicious acts of the <br /> union's representatives. <br /> 4. Duty Requirements <br /> The Union and the City agree that the President will not be required to carry out <br /> any City duties during the time they are on Chapter Chair/President's Leave for <br /> half of the normal work week. <br /> The President will be required to comply with the rules and regulations of the <br /> City as they apply to off-duty employees, except such President will not be <br /> required to report to work for any purpose during the half of the normal work <br /> week designated as Chapter Chair/President's Leave time. <br /> 5. Return to Duty <br /> Upon return to full-time City duty from Chapter Chair/President's Leave of half <br /> of the normal work week, the President shall be restored to the same position <br /> without loss of any benefits as they would have occupied or accrued if there <br /> had been no disruption in duty status. <br /> D. Meet and Confer <br /> 1. In the event the Union is formally meeting and conferring with representatives <br /> of the City on matters within the scope of representation during regular City <br /> 2025 MU City of Santa Ana&SEIU Full-Time Employees Unit Page 75 <br />
