as a party to this Lease be responsible for permitting of any construction and/or maintenance, <br /> design, assumptions or accuracy of City's construction and/or maintenance plans. <br /> All planning and architectural/design costs required to complete the construction shall be City's <br /> responsibility and shall be approved by the Director. Such approvals will not be unreasonably <br /> withheld or delayed and shall not relieve City of the responsibility for complying with all <br /> applicable codes and construction requirements, nor of obtaining necessary permits or approvals <br /> from the authorities of proper jurisdiction. <br /> 18. "AS-BUILT" PLANS AND CONSTRUCTION COSTS (PMD5.1 N) <br /> Within 60 days following completion of any City Improvement within the Premises, City shall <br /> furnish Chief Engineer with a complete set of digitally reproducible files and two sets of Record <br /> Drawings ("As-Built")plans. <br /> • Record Drawings: All CAD files are to be converted to Acrobat Reader (*.pdf format), <br /> which shall constitute the digitally reproducible files, and shall be in accordance with OC <br /> Public Works CAD Standards Manual. <br /> City must obtain Chief Engineer's approval of"As-Built"plans, and the form and content of the <br /> itemized statement corresponding to the approval. City shall also furnish the Chief Engineer with <br /> all CAD data files, which shall be in the following software format: <br /> • AutoCAD format; Microsoft Windows based system: Submission of all CAD data files <br /> shall be in accordance with OC Public Works CAD Standards Manual <br /> No other formats are acceptable. Chief Engineer reserves the right to reject CAD files <br /> delivered in any other formats not specified above. <br /> In addition, City, shall furnish Chief Engineer the recorded Notice of Completion(NOC) and <br /> an itemized statement of the actual construction costs of such improvement. The statement of <br /> cost shall be sworn to and signed by City or his responsible agent under penalty of <br /> perjury. City must obtain Chief Engineer's approval of"As-Built" plans, and the form and <br /> content of the itemized statement. <br /> 19. OWNERSHIP OF IMPROVEMENTS (2.7 SR) <br /> City shall provide all equipment necessary for use of the Premises consistent with this Lease. All <br /> improvements, and facilities, exclusive of trade fixtures, constructed or placed within the Premises <br /> by City ("City Improvements") must, upon completion, be free and clear of all liens, claims, or <br /> liability for labor or material and, at District's option shall, become property of District at the <br /> expiration of this Lease or upon earlier termination hereof. Alternatively, District retains the right <br /> to require City, at City's cost, to remove all City Improvements located on the Premises at the <br /> expiration or termination hereof. In the event that City fails to remove said City Improvements <br /> within fifteen (15) days following receipt of written notice from District to do so, such City <br /> Improvements will be deemed abandoned, and City shall lose all right, title and interest in and <br /> thereto, and District may elect(i)at City's cost,to remove,demolish, or otherwise dispose of some <br /> or all of such items, or(ii) sell or make use of any or all such items. <br /> 3/2/2026 Page 10 of 41 Lease Number <br /> Agency/Program Standard Revenue Lease Form <br />
