E. Non-Sworn: Secondary Level Proficiency in Designated Languages. An employee <br /> who is routinely and consistently assigned to a position requiring communication <br /> skills in languages other than English. where regular and frequent bilingual usage <br /> is necessary to the performance of duties, but not a major, essential, or integral <br /> element of the work and who successfully demonstrates the required level of <br /> bilingual fluency as determined by an employee's passing score on a bilingual <br /> proficiency examination shall be paid seventy-five dollars ($75)per month. <br /> F. Non-Sworn: Primary Level Proficiency in Designated Languages. An employee <br /> who is routinely and consistently assigned to a position requiring communication <br /> skills in languages other than English where bilingual proficiency is essential to <br /> carry out duties and responsibilities of a critical and/or emergency nature without <br /> ready access to backup assistance, or positions where bilingual public contact is a <br /> major, essential, or integral element of the work being performed, will be <br /> designated as Primary Bilingual Assignments. A non-sworn employee assigned to <br /> such a position who successfully demonstrates the required level of bilingual <br /> fluency shall be paid three hundred dollars ($300)per month. <br /> The parties agree that to the extent permitted by law,bilingual pay is special compensation <br /> and shall be reported pursuant to Title 2 CCR, Section 571(a)(4) and 571.1(b)(3) as <br /> Bilingual Premium. However, Ca1PERS ultimately determines whether any form of <br /> compensation qualifies as special compensation. <br /> 5.11 Temporary Upgrade Assignment Pay. The parties acknowledge that from time to time it <br /> may be necessary for the department to fill a temporarily vacant, full-time budgeted, <br /> higher-level position due to the temporary absence of the incumbent or if the higher-level <br /> position becomes vacant (up to 960 hours). The parties agree that such a position may be <br /> filled by an eligible unit member (this means an employee must meet the minimum <br /> qualifications for the higher-level position and shall be responsible for performing the full <br /> range of duties and responsibilities of the higher-level classification) for an initial period <br /> of up to six (6) months, and at the discretion of the Chief of Police, for an additional six <br /> (6) months; and that the employee assigned to fill such a position shall receive Temporary <br /> Upgrade Assignment Pay as set forth below: <br /> A. Eligibility. <br /> Full-time employees shall be assigned to fill a vacant, full-time budgeted, higher- <br /> level position, and shall receive Temporary Upgrade Assignment Pay for filling <br /> that position,when the occupier of that position is not performing the duties of that <br /> position for a period of two (2) consecutive calendar weeks or more. An employee <br /> filling a position under this section who is absent for two (2) days or less during the <br /> two (2) consecutive calendar week period will not lose their eligibility for <br /> Temporary Upgrade Assignment Pay; however, the days of absence shall not be <br /> counted in the computation of the two (2) week period. <br /> In computing qualifying service or temporary upgrade assignment pay, only full <br /> days of actual duty shall be included. Partial days shall not be combined to make <br /> full days unless they are holiday hours. Holiday time off will be included in <br /> 16 <br />
