The officer who informed MENENDEZ about the Wanted-for-Murder Flyer was <br /> 2 <br /> subsequently terminated after speaking out against Chief Valentin's decision to retaliate against (i.e., <br /> 3 <br /> 4 demote)another officer after that officer's protected disclosures.Both officers also have pending litigation <br /> 5 claims against CITY. <br /> 6 109. MENENDEZ learned that another officer took four fake Wanted-for-Murder Flyers down, <br /> 7 <br /> threw away three and placed the fourth in MENENDEZ's mailbox. <br /> 8 <br /> 9 110. MENENDEZ immediately drove to the police station to report this incident to Watch <br /> 10 Commander Gil Hernandez. <br /> 11 111. MENENDEZ also retrieved the three fake Wanted-for-Murder Flyers that had been thrown <br /> 12 <br /> away and provided them to Commander Hernandez at which time MENENDEZ stated: <br /> 13 <br /> 14 "I want to make this absolutely clear. I am filing a formal hostile work environment complaint and <br /> expect an investigation." <br /> 15 <br /> 16 112. MENENDEZ was assured that the incident would be properly addressed. <br /> 17 113. Later that day, Commander Hernandez told MENENDEZ that Commander Hernandez had <br /> 18 contacted Deputy Chief Henry Esparza who stated that MENENDEZ's complaint would be investigated. <br /> 19 <br /> T. CITY Failed to Properly Investigate MENENDEZ's Complaint. <br /> 20 <br /> 21 114. This investigation should have been rather straight-forward. <br /> 22 115. A Wanted-for-Murder Flyer is an official document used by CITY's police department and <br /> 23 its creation requires one to first log into a police department computer at the station or inside a police vehicle <br /> 24 <br /> using one's badge number, password and key card. <br /> 25 <br /> 26 116. Records reveal that the Wanted-for-Murder Flyer was posted on October 23, 2021 between <br /> 27 the hours of 1445-1700. <br /> 28 <br /> 19 <br /> MENENDEZ V.
