covered telecommunications equipment or services as a substantial or essential component of any system, <br />or as critical teclu'iology as part of any system. <br />As described in Public Law 115-232, section 889, covered telecommunications equipment: <br />(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE <br />Corporation (or any subsidiary or affiliate of sucl'i entities). <br />(2) For tlie prirpose of public safety, security of government facilities, physical security <br />surveillance of critical infrastructure, and other national security prirposes, video surveillance <br />and telecommunications eqriipment produced by Hytera Communications Corporation, <br />Hangzhou Hikvision Digital Technology Company, or Dahua Tecl'u'iology Company (or any <br />subsidiary or affiliate of sucli entities). <br />(3) Telecommunications or video surveillance services produced by such entities or using such <br />eqriipment. <br />(4) Telecommunications or video surveillance equipment or services produced or provided by an <br />entity that the Secretary of Defense, in consultation with the Director of the National <br />Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be <br />an entity owned or controlled by, or otherwise connected to, the governinent of a covered <br />foreign country. <br />v. Domestic Preferences for Procurements/Subcontracts - Recipient will comply, and all its <br />contractors (or subrecipients) will comply, with all requirements under Uniform Guidance 2 CFR <br />§200.322. <br />Recipient shall comply witli the federal and recipient standards in the award of any subcontracts. <br />For purposes of this Agreement, subcontracts shall include but not be limited to purchase agreements, <br />rental or lease agreements, third party agreements, consultant service contracts and construction <br />subcontracts. <br />Recipient sl'iall ensure that tlie terms of this Agreement with the CITY are incorporated into all <br />Subcontractor Agreements. The recipient shall submit all Subcontractor Agreements to the CITY for <br />review prior to the release of any fiinds to the subcontractor. The recipient shall witl'ihold funds to any <br />subcontractor that fails to with the terms and conditions of tliis and tlieir <br />respective Subcontractor Agreement. <br />Recipient shall make maxu'num use of recovered materials that are EPA- <br />designated items unless the product cannot be acquired competitively within a timeframe providing for <br />compliance with tlie contract performance schedule; Meeting contract performance requirements; or at a <br />e prtce. <br />Information about this requirement, along with the list of EPA-designated items, is available at <br />EPA's Comprehensive Procurement Guidelines webpage: https://www.epa.gov/smm/comprehensive- <br />procurement-guideline-cpg-program. <br />The Contractor also agrees to comply with all otlier applicable requirements of Section 6002 of <br />the Solid Waste Disposal Act.
