(2)Domestic Preference for Procurements <br />Recipient should, to tlie greatest extent practicable, provide a preference for the purchase, <br />acquisition, or use of goods, products, or materials produced in the United States. Tl'iis includes, but is not <br />limited to iron, aluminum, steel, cement, and other manufactured products. <br />For purposes of this clause: <br />Produced in the United States means, for iron and steel products, that all mamifacturing <br />processes, from the initial melting stage through the application of coatings, occurred in the United States. <br />Manufactured products mean items and construction materials composed in whole or in part of <br />non-ferrous tnetals such as aluminum; plastics and polymer-based products such as polyvinyl chloride <br />pipe; aggregates sucli as concrete; glass, including optical fiber; and lumber. <br />w. Termination for Cause and Convenience - Should recipient fail for any reason to comply <br />with the contractual obligations of this agreement within the time specified by this Agreement, the CITY <br />reserves tlie right to terminate the Agreement, reserving all rights under state and federal law. <br />x. Contractual/Legal Remedies for Breacli of Contract - Shorild recipient fail for any reason <br />to comply with the contractual obligations of tliis Agreement and/or willfully, knowingly or negligently <br />breach any term, condition or requirement of the agreement, City may impose sanctions including but not <br />limited to damages (liquidated damages and or penalties) and /or any other remedy available pursuant to <br />the Agreement of the laws tl'ien in effect. <br />y. Conflict of Interest - In tlie event a conflict of interest is identified, disciplinary action <br />shall be determined and imposed based on the severity of the violation and may include, but is not limited <br />to, written warnings, suspension, mandatory ethics training, reassigtu'nent of duties, or terinination of <br />employment. All disciplinary action takei'i/imposed, will be documented and handled in accordance with <br />applicable federal, state and local employment laws.
