They described the shooter as a male Hispanic <br />wearing a red lieavy sweater possibly entering a white Toyota pickup and leaving the area. Officer D. <br />Garcia said a motor officer advised he might have the vehicle and the vehicle was not yielding. Officer <br />D. Garcia said as they were driving south on Main Street the motor officer told them via the radio that <br />the vehicle was going northbound and as he looked to his left he saw the vehicle. He also saw the male, <br />Hispanic with a red sweater driving a white Toyota. Officer D. Garcia said he was able to see inside the <br />vehicle and he was only able to see he was the only occupai'it in the vehicle. They then made a U-turn <br />and got behind the vehicle. He said their overhead lights were activated with a forward facing red <br />light. The suspect vehicle stopped and they both immediately exited the vehicle. Officer D. Garcia <br />began giving commands in English and Spanish telling the subject to tun the car off and let me see your <br />hands. Officer D. Garcia said while utilizing the truck's mirror to look inside the vehicle, lie observed the <br />subject do the sign of the cross on his body. <br /> Officer D. Garcia <br /> " <br /> He <br />said the subject continued to sqrieeze the trigger, but based on his experience the subject had a <br />malfiu'iction or he ran out of rounds. Officer D. Garcia sees him bring the gun down and he appeared to <br />be angry. Officer D. Garcia sees the subject rack the gun, smacks the magazine and does the sign of the <br />cross again Officer D. Garcia tells him both in English and Spanish, <br /> Officer D. Garcia <br />said the subject was not listening to him and he was cornrnitted to do what he was going to do. Officer <br />D. Garcia observes the subject get the plione and put it up to his ear and then he puts it down. He then <br />observes the subject squeeze the trigger and a shot goes off. Immediately after that, he hears the <br />reeving of the engine. his foot was <br />resting on the gas pedal. At this time he requested a shield and some officers. <br />Officer D. Garcia said he stepped inside his vehicle to elevate himself to get a better view inside the <br />ttuck and he noticed the subject was not dead and he was moving. Officer D. Garcia said the subject was <br />bringing his head up while holding the gun in his left hand. He advises the officers to stop becarise he <br />was still alive and the engine stops reeving. He also advises the officers that the suspect still has the gun. <br />-O- ffi-ce-r D. He sees the subject get the cell phone and dial, bringing the phone to <br />his ear while holding the gun. He sees the subject put the phone down while giving him orders to drop <br />the gun both in English and Spanish. Officer D. Garcia then observed the subject reaching with his right <br />hand prishing the door open. He observes the subject holding the cell phone with his right hand and the <br />hand gun in his left hand. He observes the subject push the door open and come out in a crouched <br />position. The suspect sqriares off at this point standing up holding the handgun with his left hand and the <br />cell phone on his right hand. Officer D. Garcia yells gun several times. He tells the subject to drop the <br />gun and don't do it but the suspect to present the gun towards them as a threat. At this time based on the <br />initial call where the srispect shot at someone, the fact he was ignoring the cornrnands to drop the gun <br /> and now that he is outside the vehicle and continuing to ignore the commands to <br />drop the gun, Officer D. Garcia perceived the handgun as a threat to his safety and of his fellow officers. <br />Officer D. Garcia believed the subject posted a threat to them and he discharged one round aimed at <br />center mass. <br />Officer D. Garcia stated they approached and he began instructing officers to assist in rendering aid to <br />the subject. Officer D.
