Santa Aria PD 2015-06456: Supplemental Report by #2770 Page 3 of 4 <br />(OIS) which occurred in the area of 200 S. Main Street. During investigation into this <br />OIS, and were identified as witnesses. <br />At approximately 1617 hours, QC DA Investigator D. Fulcher and I conducted an <br />interview with This interview was conducted, in Spanish, within the business <br />located at 312 S. Main Street (The Mill Bakery) and audio-recorded by DA Inv. Fulcher. <br />Subsequent to the interview, DA Inv. Fulcher retained custody of said recording. Below <br />is a synopsis of the interview conducted with Ascencio. For complete details in regard to <br /> statements, please see DA Inv. Fulcher's report and the above indicated <br />recording. <br />At the beginning of the interview we introduced ourselves to nd obtained his <br />personal information as listed above. We then asked him to provide any and all <br />infornnation he held in regard to the OIS we were investigating. In response, <br />told us the following. It should be noted that at the time of our interview Osorio's vehicle <br />was stopped in the northbound lanes of 200 S. Main Street, facing north, and positioned <br />just north of the building within which we conducted our interview. <br /> identified himself as the of The Mill Bakery. He then told us that <br />immediately prior to the shooting he was in the rear/kitchen area of the business. While <br />there, he was alerted to a commotion/police activity occuring in front of the business. <br />When he responded to the front of the bakery, he saw "the white truck" stopped on the <br />street with several police officers (five (5) to six (6) in number) standing behind it. These <br />officers, in addition, were standing outside of their respective police cars and pointing <br />their weapons at this vehicle. As made these statements, he gesticulated toward <br />ihefrontofthelocationandindicatedthattheyehiclewasstillpar-ked-ther-e. B-ythis <br />motion, and vehicle description, I understood him to be speaking of Osorio's pick-up. <br />Upon ariving to the dining/sales area of the bakery, and noting the police <br />activity, directed his staff to close the front door. As he continued to view the <br />activity, for a period of approximately ten (10) minutes, saw that an occupant of <br />the vehicle was preparing to exit. From his vantage point, however, could not <br />ascertain exactly what this person was doing while seated inside of the pick-up. He did <br />not, however, relate this inability to see directly to the window tint of the vehicle as the <br />coloring was only half-way dark. <br />As the person described above subsequently exited the vehicle, could see that <br />he was covered in blood especially in the area of his face. He also described this person <br />as being of his approximately height (5 1/2 feet tall), of medium build, light <br />brown to medium brown skin complexion and dressed in a red shirt. By this description, <br />I believed to be speaking of Osorio. As Osorio continued to exit the vehicle, <br /> could see that he had a black medium size framed pistol in his hands. While <br />making this statement made the hand gesture as if holding a gun with both <br />hands. further indicated that Osorio was pointing the weapon at the ground <br />after exiting his truck.
