You indicated that he gave the sign of the <br />cross, uh, I’m assuming we’re talking about the suspect in the, in the <br />driver’s seat of the vehicle? <br />GARCIA: Yes. <br />SMITH: Uh, did he do that prior to your commands? <br />GLAVE: Prior to any commands being given? <br />SMITH: Prior to any commands that you gave as far as stopping the vehicle, <br />getting out of the vehicle, putting his…your hands up, anything like that <br />did he, did you see him do that before you gave any verbal commands to <br />him? <br />GARCIA: Um, I can't remember. <br />SMITH: Okay. Do you recall if the driver window or any of the windows on the <br />vehicle were down? <br />GARCIA: I believe the, uh, driver’s window was down. <br />SMITH: Okay.
