Uh, and at the point where you decided to fire your four or five <br />rounds what were his actions at that time? <br />SHIFFLETT: Uh, he…I think after the first shot he kinda he stands up a little bit, uh, <br />there was hesitation between my first and second, uh, and then my <br />follow one shots, uh, he kinda I think I was just, I was just tracking his <br />movement more so I just with my, with my optics as opposed to seeing <br />exactly what his movements *** were if that makes sense. Uh, he kinda <br />comes up and then starts going down, uh, and I just *** my last shot was <br />after, well after my last shot is when he’s down and that was, now the <br />guns out of his hand. <br />SMITH: Okay. So your backdrop, uh, for the shooting would have been his pickup <br />truck cuz he stayed near the passenger, uh, I’m sorry yeah the rear door <br />on the driver’s side would have been your backdrop for, for your shot? <br />SHIFFLETT: Yes, sir. <br />SMITH: Okay. Uh, just prior to shooting let me, let rephrase that. Why did you <br />shoot? <br />SHIFFLETT: Cuz he was *** he was fixing to fire at my partners. <br />SMITH: And what actions did he do that indicated that to you?
