<br /> <br /> <br /> <br /> the trolley route, within twenty-four hours of notification of such graffiti. If said <br /> removal is not completed within said twenty-four hours, Licensor shall order its <br /> contractor to remove the graffiti and charge Licensee for such services. <br /> e. This License is made subject and subordinate to the prior and continuing right <br /> of Licensor to use the License Area for public right-of-way purposes. In the event the <br /> License Area is required for other public purpose, or Licensor's own use, Licensor <br /> will provide written notice one week in advance and Licensee and Operator will <br /> bypass the trolley stop associated with Licensee's use of the License Area, or make <br /> other arrangements for trolley stop, as approved by the Executive Director of Public <br /> Works. <br /> f. The initial hours of operation of the downtown trolley loop shall be limited to <br /> Thursday and Friday between 4 pm and 8 pm. Licensee may, on the written <br /> agreement of the Deputy City Manager for Development Services, expand the hours <br /> to include a lunch hour trolley loop. <br /> 3. DUTIES OF LICENSEE <br /> a. In exercising these rights, Licensee and Operator must use reasonable care <br /> and may not unreasonably increase the burden on the License Area. Licensee and <br /> Operator agree that any use of the License Area as specified herein shall be affected <br /> with all reasonable diligence and precaution to avoid damage to the land, property or <br /> personnel of Licensor and the public. <br /> b. Licensee and Operator agree to conform to any reasonable requirements set <br /> forth by the Licensor related to the use of the License Area as a passenger boarding <br /> stop during the course of this License. <br /> C. Licensee and Operator agree to follow all provisions of the California Vehicle <br /> Code and the Santa Ana Municipal Code when operating the downtown trolley <br /> system in accordance with this license. The failure to comply with the lawful <br /> provisions of those codes, or any other safety violations that endanger the welfare of <br /> passengers, pedestrians, or the motoring public, shall serve as sufficient cause for <br /> immediate revocation of this license by Licensor. <br /> d. Ingress and Egress to License Area 2 shall be off Santiago Street. <br /> e. Licensee may install signage indicating the location of the trolley stop and <br /> time of operation of the trolley system. Except as set forth herein, Licensee shall <br /> make no improvements nor installation to License Area 1 or License Area 2 without <br /> the written approval of the Licensor. Licensee agrees to pay all the costs of the <br /> installation, operation, maintenance, repair and removal of any such improvements in <br /> the License Area. <br /> f. Licensee will keep the License Area in a neat, clean, sanitary and safe <br /> condition, to the satisfaction of Licensor, at the sole cost and expense of the <br /> Licensee. It should be maintained in a manner consistent with community standards <br /> which will uphold the value of the Property, in accordance with this Agreement, the <br /> Santa Ana Municipal Code and all other applicable local, state and federal rules, <br /> regulations and standards. <br /> 2 <br />
