EXHIBIT 2 <br /> CITY OF SANTA ANA <br /> property and adjacent property. Damages to properties caused by Consultant's negligence <br /> shall be repaired at no cost (both labor and material)to the City. <br /> Consultant is responsible for advising and ensuring compliance by Consultant's employees <br /> with all applicable environmental and hazardous materials handling laws and regulations. <br /> Consultant shall provide City a full report of damage to City property and/or equipment by <br /> Consultant's employees. All damage reports shall be submitted to the Site Coordinator within <br /> twenty-four (24) hours of occurrence. <br /> Consultant shall provide, erect, and maintain all warning devices (i.e., barricades, cones, <br /> etc.) as required or necessary to ensure the safety of the public, City, and Consultant's <br /> employees. <br /> H. SPILL LIABILITY <br /> The City does not assume liability for spills or other releases of hazardous wastes which are <br /> caused by the negligence of the Consultant once hazardous waste materials are in the <br /> possession of the Consultant or transported off site. <br /> I. RECORDKEEPING AND REPORTS <br /> Consultant is required to provide upon request, detailed data and information required by the <br /> City. Information may include: generator EPA ID, Consultant EPA ID, generator name, waste <br /> description, manifest number and line number, date waste shipped, disposal and recycling <br /> facilities utilized, final disposal method utilized, quantity shipped (pounds), waste profile <br /> number, and any additional information requested. <br /> All records and reports shall be available in electronic (including Excel, Word, and PDF <br /> Format) and hard copy format at all times during the term of the contract. <br /> XIV. FEDERAL FUNDING REQUIREMENTS <br /> A. FEDERAL AID CONTRACT PROVISIONS <br /> Proposers are advised that this project is federally funded and they shall comply with all <br /> federal requirements in the Agreement. <br /> B. CALTRANS ATTACHMENTS <br /> Attachment J includes the required forms for reference and submitting. The forms can be <br /> found at: https://dot.ca.aov/programs/local-assistance/forms/local-assistance-procedures- <br /> manual-forms. <br /> Please reference Caltrans Local Assistance Procedure Manual, Consultant Selection, <br /> Chapter 10, for further instructions and guidelines pertaining to the completion of these <br /> forms:https://dot.ca.gov/-/media/dot-media/programs/local- <br /> assistance/documents/lapm/ch 10.pdf <br /> XV. AWARD OF AGREEMENT <br /> Selected Consultant(s) will be notified in writing. Any award is contingent upon the successful <br /> negotiation of final Agreement terms. <br />
