SA 12‐022 <br />Investigator: ANDREW ROSS Approved By: <br />Date of Report: 10/04/12 Date:10/10/12 <br />Page 46 of 76 <br />ROSS: So in, in your mind, you’re still, still believe that, that’s a firearm <br />that he’s holding against his chest? <br />ENRIQUEZ: Without a doubt. <br />ROSS: Okay. (PAUSE) Do you, you, you said  there wasn’t enough time to <br />say anything. Um, at what, at what point do you deliver those <br />first, you said  first four rounds that you fired? <br />(BACKGROUND NOISE) <br />ENRIQUEZ: At that moment. <br />ROSS: Okay. <br />ENRIQUEZ: As I aimed  at his direction, I was confident with my back drop and <br />I fired  four rounds at him. <br />ROSS: Okay. Anything, did you hear the suspect say anything at that <br />time? <br />ENRIQUEZ: No. I did not hear him say okay, okay, I give up. I stop or I’m hurt, I <br />did not, umࡕ I obviously looked to see if I had struck him to <br />minimize the threat. I wasn’t convinced  that I had. Again, he had <br />cover concealment, um, no indication and four rounds, it was very <br />clear that I was engaging him. And I paused, giving him an <br />opportunity to give up do anything. He wasn’t. And based on his <br />actions again he started  to move and I saw his feet now move side <br />to side as he was squatting. So no he did not say anything or do <br />anything to lead me to believe that it was safe.
