S.A. 12‐022 <br />Investigator: ANDREW ROSS Approved By: <br />Date of Report: 09/13/12 Date: 09/18/12 <br />Page 5 of 6 <br />together, cradling the object in his hands. was unable to identify the object; however, <br />based on the way ALMANZA was holding the object, believed it was a firearm. <br />ALMANZA was crouched down at the front of the Jeep, using the Jeep as cover. <br />ALMANZA kept bobbing his head up and down in front of the vehicle, in an attempt to see <br />where ENRIQUEZ was located. ENRIQUEZ continued to yell commands at ALMANZA. <br /> described ALMANZA as being argumentative with ENRIQUEZ, as ENRIQUEZ yelled <br />commands at ALMANZA. ALMANZAs response to ENRIQUEZs commands was No! No! At <br />one point, ENRIQUEZ told ALMANZA to get on the ground. ALMANZA responded by stating, <br />No, you do that. <br />From ENRIQUEZs location, in front of the patrol vehicle, ENRIQUEZ fired his firearm <br />twice at ALMANZA; however, believed that ALMANZA was not struck by the bullets. <br />ENRIQUEZ then began to move in a northeasterly direction. ALMANZA lay on the ground and <br />crawled under the front of the Jeep, where he continued to watch ENRIQUEZ from below the <br />front of the vehicle. While lying below the front of the vehicle, ALMANZA constantly groped his <br />right pants pocket area, as though he was attempting to retrieve an item from his pants pocket. <br />ENRIQUEZ continued moving in a northeasterly direction on the passengers side of the <br />Jeep. As he did so, ENRIQUEZ continuously issued commands to ALMANZA; Let me see your <br />hands, Lay flat on the ground, Put your hands flat on the ground. ALMANZA did not <br />comply with ENRIQUEZs commands and continued to reach towards the pocket of his pants. <br />After groping the pocket of his pants, ALMANZA brought his hands back together in front of <br />him, as though he was pointing a firearm at ENRIQUEZ. <br />When ENRIQUEZ stopped moving in a northeasterly direction, he was approximately 15 <br />to 20 feet east of the front of the silver Jeep.
