Another police officer then pulled his car into the parking lot. described the man who was shot and involved in the fights as being approximately 28 years old, with brown hair, wearing a black short sleeved tee shirt and jeans. At approximately noon, saw two men involved in a fist fight near the McDonald’s restaurant. recognized one of the combatants as the man whose body she saw later in front of juice shop. said he was fist fighting with another man that she had not seen before. At approximately 1500 hours, observed a police car pull across the parking area with its emergency lights on. She wanted to go see what was going on but was on the telephone with a customer. Shortly thereafter she heard a gunshot. She got up and walked outside, but her view was blocked by other spectators who were standing at the corner of the building. She eventually saw the body on the ground and recognized it as being the homeless man who frequents this shopping center and had been in the earlier fight.
