Initially there were a couple other patrons in the restaurant, but they left soon after <br /> ’s arrival. received her juice and sat down facing east, at the second table, <br />west of the entrance door. telephoned her boyfriend; , using her <br />cellular telephone. <br />As was on her cellular telephone speaking with , a male subject, <br />later identified as HANS KEVIN ARELLANO, ran into the restaurant out of breath. <br />described ARELLANO as a male Hispanic, late 20’s to early 30’s, with short black or dark brown <br />hair, unknown on facial hair, wearing a long white un-tucked short sleeve tee shirt, jean pants, <br />and no hat. further described ARELLANO as looking like a “looser,” “up to no good” <br />“a little scruffy” and “a wanna be gangster” or “thug.” She did not remember him having <br />anything in his hands. <br />As ARELLANO entered the restaurant, he looked around, smiled at , turned <br />east, then stood facing north in front of a “juke box” acting as if he was trying to select a song. <br />Approximately a minute afterwards, a female police officer, later identified as SAPD <br />Officer JESSICA GUIDRY, arrived in a police vehicle, and parked, facing west, to the rear of <br /> ’s vehicle. GUIDRY exited her vehicle, stood in front of the open driver’s door, <br />withdrew her handgun and pointed it at ARELLANO, with a two handed grip. GUIDRY was on <br />the driver’s side of ’s vehicle at that time. GUIDRY yelled commands at ARELLANO, <br />similar to, “Put your hands up, come out with your hands up,” and other commands that were <br />inaudible to . <br /> GUIDRY moved from the asphalt parking lot up onto the sidewalk, in front of the <br />restaurant entrance door.
