As ARELLANO moved toward the <br />door, he initially put both of his hands up, shoulder height, with his palms facing out. Then he <br />put both hands down toward his front pant pockets and started to “fidget” with the outside of <br />his pant pockets. ARELLANO then put both of his hands up again, shoulder height, with his <br />palms facing out, then back down to the outside of his front pant pockets, fidgeting with them, <br />as he exited the restaurant, approaching GUIDRY. ARELLANO was moving his hands, “really <br />fast,” laughing, smiling and didn’t appear to be taking it serious. thought he was <br />being a “smart ass.” <br />After ARELLANO exited the restaurant, he stepped toward GUIDRY “real fast,” “lunged” <br />at her in a “what’s up type lunge,” at which time heard a loud bang. had <br />looked away just prior to the loud bang and did not actually see GUIDRY fire her weapon. <br /> told us that ARELLANO must have “frightened her or caught her off guard,” referring <br />to GUIDRY. speculated that ARELLANO was trying to intimidate GUIDRY. Later in the <br />interview, said GUIDRY was on the parking lot asphalt when she fired her weapon. <br />After the loud bang, looked back toward ARELLANO, saw him grab his chest, <br />look at her, and fall to the sidewalk. Other police officers arrived and and the female <br />employee then ran into the kitchen. did not see any weapons in ARELLANO’s hands <br />during the incident. She estimated the interaction between GUIDRY and ARELLANO lasted <br />approximately a minute and a half. <br /> said she was on her cellular telephone, talking to throughout the <br />incident and he should have heard the gunshot.
