DBA 2010-01 and TTM 2009-01 <br />August 9, 2010 <br />Page 5 <br />Goal 3 <br />Preserve and improve the character and integrity of existing <br />neighborhoods. <br />Policy 3.1 Support development which provides a positive contribution to <br />neighborhood character and identity. <br />Policy 3.5 Encourage new development and/or additions to existing development <br />that is compatible in scale, and consistent with the architectural style and <br />character of the neighborhood. <br />Policy 5.5 Encourage development which is compatible with, and supportive of <br />surrounding land uses. <br />Tentative Tract Map <br />In order to allow the sale of the units, the applicant is proposing a tentative tract map for <br />condominium purposes. Since the topography of the site is flat and its geometry is rectangular, the <br />site has been determined to be physically suitable for a residential development at the proposed <br />density since there are no physical constraints on the site to preclude development. <br />In summary, the density bonus deviations requested will allow for the construction of one additional <br />affordable unit, increasing the total supply of affordable for-sale units available in the community <br />for that level of affordability. Staff recommends that the Planning Commission adopt a resolution <br />approving the requested deviations from Chapter 41of the Santa Ana Municipal Code (SAMC), <br />contained in Density Bonus Application No. 2010-01 and adopt a resolution approving Tentative <br />Tract Map No. 2009-01, as conditioned. <br />CEQA Compliance <br />In accordance with the California Environmental Quality Act, the proposed project is exempt from <br />CEQA review per Section 15332, class 32. The Class 32 exemption allows infill development <br />projects occurring on lots less than five acres, where the site has no value as a habitat for <br />endangered species, is adequately served by all required utilities and public services, will not result in <br />any significant effects relating to traffic, noise, air and water quality, and is consistent with the <br />applicable general plan, zoning and other policies.
