The Union shall provide an insurance policy or policies, or certificate of <br /> such insurance, naming the City of Santa Ana, its officers and employees <br /> as insured or additional insured which provides coverage against liability <br /> for any and all claims and/or suits for damages or injuries to persons or <br /> property resulting from or arising out of any act or omission of said Union <br /> representative. Said policy or policies of insurance shall provide coverage <br /> for both bodily injury and property damage not less than the following <br /> minimum amounts: One million dollars ($1,000,000) combined single <br /> limit or its equivalent. Said policy or policies shall also contain a <br /> provision that no termination, cancellation or change of coverage of <br /> insured or additional insured shall be effective until thirty (30) days notice <br /> thereof has been given in writing to the City of Santa Ana. <br /> <br /> 9. The Union shall provide the City of Santa Ana with an insurance carrier <br /> certifying that it carries primary workers' compensation insurance on <br /> behalf of said Union representative and the policy shall not be canceled <br /> nor coverage reduced except upon ten (10) working days prior notice to <br /> the City of Santa Ana. <br /> <br /> 10. The Union shall indemnify and save harmless the City of Santa Ana, its <br /> officers and employees from and against any and all damage to property or <br /> injuries to or death of any person or persons, including property and <br /> employees or agents to the City of Santa Ana. The Union shall defend, <br /> indemnify, and save harmless the City of Santa Ana, its officers and <br /> employees from any kind and all claims to demands, suits, actions or <br /> proceedings of any kind or nature, including, but not by way of <br /> limitations, workers' compensation claims, resulting from or arising out of <br /> the negligent acts, errors, or omissions, arising out of the intentional or <br /> malicious acts of the Union's representatives. <br /> <br /> 11. The Union and the City of Santa Ana agree that the Union President will <br /> not be required to carry out any City duties during the time the Union <br /> President is on President's leave twenty (20) hours per week. The Union <br /> President will be required to comply with the rules and regulations of the <br /> City of Santa Ana as they apply to off-duty employees, except such Union <br /> President will not be required to report for any purpose during the four (4) <br /> hours per day or twenty (20) hours per week of Union President's leave <br /> time. <br /> <br /> 12. Upon return to duty from President's Leave of four (4) hours per day, the <br /> Union President shall be restored to the same position without loss of any <br /> benefits as he or she would have occupied or accrued if there had been no <br /> disruption in duty status.
