The employee taking Union <br /> Business Leave shall not unreasonably interfere with the operation <br /> of the City department and shall be approved by the employee's <br /> Department Head. The Department Head shall not unreasonably <br /> withhold permission to utilize President's Leave time and/or Union <br /> Business Leave from any employee who has been duly authorized <br /> by the Union to take such leave. <br /> <br /> No withdrawal from or use of such bank may be made by or on <br /> behalf of an employee ordered to take time off without pay for <br /> disciplinary reasons. No withdrawal or use of such bank may be <br /> made by or on behalf of any employee to be used for purposes that <br /> are unlawful under the laws of the United States, State of <br /> California or the ordinances of the City of Santa Ana. <br /> <br /> The Union President shall have up to twenty (20) hours per week <br /> or one thousand forty (1,040) hours per year of time off to conduct <br /> Union business which shall be paid by the City, but reimbursed to <br /> the City by the Union from either the above described bank or <br /> directly from the Union treasury. In any event, the Union agrees to <br /> reimburse the City for all costs not otherwise reimbursed from the <br /> bank providing the Union President with President's leave of <br /> absence. <br /> <br /> Time spent by the Union President on President's Leave time shall <br /> not be considered time worked for the computation of overtime <br /> according to the Fair Labor Standards Act. <br /> <br /> 18.2 Worksite Access. <br /> <br /> A. Officers, worksite leaders/stewards and/or paid Union representatives shall be <br /> permitted to visit break and lunch areas designated by the City, before or after <br /> work or during designated lunch periods for the purpose of discussing Union <br /> business, provided that arrangements are made in advance with the manager <br /> responsible for the worksite. <br /> <br /> B. Such visits shall not disrupt the work of City employees, interfere with the normal <br /> operations of the department or with established safety and security requirements. <br /> Where any such problems arise, the Union and the City will agree on an alternate <br /> meeting/conference facility for the purpose of providing a place for the Union to <br /> hold a meeting before or after work or during lunch periods. If the City facility <br /> provided the Union as an alternate meeting site during non-working hours is a <br /> public meeting room, its scheduling and use shall be governed in accordance with <br /> regulations pertaining to the use of public meeting rooms at City facilities. <br /> <br /> <br /> 65 <br /> 25F-67 <br />
