days so that the bills are paid in a timely manner as stated (within thirty <br />(30) days of its receipt). <br />8. The Union shall provide an insurance policy or policies, or certificate of <br />such insurance, naming the City of Santa Ana, its officers and employees <br />as insured or additional insured which provides coverage against liability <br />for any and all claims and/or suits for damages or injuries to persons or <br />property resulting from or arising out of any act or omission of said Union <br />representative. Said policy or policies of insurance shall provide coverage <br />for both bodily injury and property damage not less than the following <br />minimum amounts: One million dollars ($1,000,000) combined single <br />limit or its equivalent. Said policy or policies shall also contain a <br />provision that no termination, cancellation or change of coverage of <br />insured or additional insured shall be effective until thirty (30) days notice <br />thereof has been given in writing to the City of Santa Ana. <br />9. The Union shall provide the City of Santa Ana with an insurance carrier <br />certifying that it carries primary workers' compensation insurance on <br />behalf of said Union representative and the policy shall not be canceled <br />nor coverage reduced except upon ten (10) working days prior notice to <br />the City of Santa Ana. <br />10. The Union shall indemnify and save harmless the City of Santa Ana, its <br />officers and employees from and against any and all damage to property or <br />injuries to or death of any person or persons, including property and <br />employees or agents to the City of Santa Ana. The Union shall defend, <br />indemnify, and save harmless the City of Santa Ana, its officers and <br />employees from any kind and all claims to demands, suits, actions or <br />proceedings of any kind or nature, including, but not by way of <br />limitations, workers' compensation claims, resulting from or arising out of <br />the negligent acts, errors, or omissions, arising out of the intentional or <br />malicious acts of the Union's representatives. <br />11. The Union and the City of Santa Ana agree that the Union President will <br />not be required to carry out any City duties during the time the Union <br />President is on President's leave twenty (20) hours per week. The Union <br />President will be required to comply with the rules and regulations of the <br />City of Santa Ana as they apply to off-duty employees, except such Union <br />President will not be required to report for any purpose during the four (4) <br />hours per day or twenty (20) hours per week of Union President's leave <br />time. <br />12. Upon return to duty from President's Leave of four (4) hours per day, the <br />Union President shall be restored to the same position without loss of any <br />benefits as he or she would have occupied or accrued if there had been no <br />disruption in duty status.
