Commissioner Lutz remarked about past incidents at the site while under prior <br />ownership. SAPD Yolanda Pena stated the current location does not generate a <br />lot of police calls; she reviewed the record of incidents within the last two years <br />as well as stated that Officer McCoy does on-site inspection for compliance. <br />Commissioner De La Torre asked for clarification of the 1990 conditional use <br />permit that limited hours of operation to 10:00 p.m. SAPD Officer Pena clarified <br />that of the 36 calls for police, the majority were not related to the alcohol at the <br />premises. Both conditional use permits require one security guard per 100 <br />attendees. Monitoring of the business is required by Planning Condition No. 22. <br />Mr. Kaufman commented on modifications to Police Conditions No. 2, No. 8 and <br />No. 9. <br />The public hearing was opened. <br />Sean H. Mill provided a letter in opposition to the issuance of an alcohol license <br />and extension of operating hours. <br />Reverend Will B. King spoke in opposition to the issuance of an alcohol license. <br />Nelida M. Yanez spoke in opposition to the issuance of an alcohol license and <br />extension of operating hours. <br />Frank Mitchell III spoke in support of the applicant. <br />Mike Gonzalez spoke in support of the issuance of the alcohol license and <br />extension of operating hours. <br />Debbie McEwen spoke in opposition to the issuance of an alcohol license and <br />extension of operating hours. <br />The public hearing was closed. <br />Commissioner Cribb inquired about general crime rate in the area. SAPD Officer <br />Pena indicated there was not sufficient data to support a denial. <br />Commissioner Gartner expressed assurance that periodic monitoring by police <br />department was incentive for the owner to be in compliance with the conditions so <br />they do not lose their license. <br />Commissioner Lutz reviewed compliance of conditions by the applicant that would <br />promote safety and monitoring by police department. <br />Mr. Kaufman recapped the conditions that were imposed prior to 1990 with an <br />overlap between the new conditions affecting the extension of operating hours. He <br />stated that several new conditions would be imposed on the applicant. <br />Commissioner Cribb voiced concern that with afamily-oriented business there <br />might be an incentive to not report incidents. He clarified the title for the facility, EI <br />Flamingo Restaurant and Nightclub and confirmed that food would be served until <br />1:30 a.m. <br />Chair Leo recapped Item D (CUP 2006-15): current restaurant approved opened <br />until 11:00 p.m.; 27 new conditions were imposed, and restaurant located in an <br />above-average crime rate, with SAPD recommendation and upgrading conditions <br />for the applicant. <br />Commissioners Betancourt, De La Torre and Cribb stated that given the <br />conditions, the recommendation from the Police Department, and given the fact <br />the facility would be reviewed in six months, support the extension of operating <br />hours. <br />Planning Commission Minutes 5 October 23, 2006 <br />
