D. On May 1, 2009, the Planning Commission conducted the <br />necessary review pursuant to Santa Ana Municipal Code Section <br />41-593.5(c). <br />E. After considering all of the evidence submitted, the Planning <br />Commission finds and determines that Neighborhood Project <br />Review No. 2009-01 is consistent with both the Heninger Park <br />Design Guidelines and the Citywide Design Guidelines in regards <br />to architectural style and method of operation. <br />F. In accordance with the California Environmental Quality Act, the <br />proposed project is exempt from further review pursuant to Section <br />15301, Class 1 and Section 15303, Class 3. This Class 1 <br />exemption allows for the demolition and removal of individual small <br />structures, including garages as well as addition to existing <br />structures not resulting in an increase of more than 10,000 square <br />feet. In addition, this Class 3 exemption allows for the construction <br />of new accessory (appurtenant) structures including garages, <br />carports, patios, swimming pools and fences. Categorical <br />Exemption Environmental Review No. 09-52 will be filed for this <br />project. <br />Section 2. The Planning Commission hereby approves Neighborhood <br />• Project Review No. 2009-01.
