5. Will the proposed use adversely affect the General Plan or any <br />specific plan of the City? <br />Goal 2.0 of the Land Use Element of the City's General Plan <br />provides that the City shall "promote land uses which <br />enhance the City's economic and fiscal viability." Approval <br />of this application would adversely affect the City's ability to <br />achieve this Goal, as well as Land Use Element Policy <br />Numbers 2.2, 2.5 and 2.8. <br />F. In accordance with Public Resources Code section 21080(a)(5), the <br />proposed project is exempt from further review under the California <br />Environmental Quality Act because this project is disapproved. <br />Section 2. The Planning Commission after conducting the public hearing hereby <br />denies Conditional Use Permit No. 2005-26. This decision is based upon the evidence <br />submitted at the abovesaid hearing, which includes but is not limited to: the Request for <br />Planning Commission Action dated November 28, 2005 and exhibits attached thereto; <br />and the public testimony, all of which are incorporated herein by this reference. <br />ADOPTED this 28th day of November, 2005 by the following vote: <br />AYES: Commissioners: Leo, Rodriguez (2) <br />NOES: Commissioners: Betancourt, Cribb, Lutz (3) <br />• ABSENT: Commissioners: De La Torre (1) <br />ABSTENTIONS: Commissioners: Gartner (1) <br />~ /~ f <br />Christop er eo <br />Vice-Chairman <br />APPROVED AS TO FORM: <br />Joseph W.
