If transferred or reassigned to a different department and a <br /> hardship continues, a new hardship claim must be filed with the <br /> new Department Head. <br /> <br /> 7. It is the employee's responsibility to notify his/her supervisor if the <br /> hardship terminates and return to the normal 9/80 work <br /> schedule. <br /> <br /> Inconvenience or preference does not constitute a hardship. <br /> <br /> 4.4 Overtime Defined. All FLSA nonexempt employees working under the "9/80" <br /> work schedule shall earn overtime for all hours worked after the first forty (40) <br /> hours in an FLSA work week as required under FLSA. Employees are required <br /> to obtain supervisor authorization before working any overtime. <br /> <br /> A. Overtime Compensation. Overtime work, and compensation for same, <br /> shall follow the provisions stated in Article VII - Overtime. <br /> <br /> B. Compensatory Time. Terms and compensation for Compensatory Time <br /> <br /> shall follow the provisions stated in Article VII - Overtime. <br /> <br /> 4.5 Leave Benefits. When an employee is off on a scheduled workday under the <br /> "9/80" work schedule, nine (9) hours of eligible leave per workday shall be <br /> charged against the employee's leave balance; if the day off is a Friday, <br /> then eight (8) hours shall be charged. When an employee is off on a <br /> scheduled workday under the "4/10" work schedule, ten (10) hours of eligible <br /> leave per workday shall be charged against the employee's leave balance. <br /> All leaves shall continue under the current accrual, eligibility, request and <br /> approval requirements. <br /> <br /> A. Vacation Leave. Provisions for vacation leave are found in Article X of <br /> this MOU. <br /> <br /> B. Sick Leave. Provisions for sick leave are found in Article XI of this MOU. <br /> <br /> C. Bereavement Leave. Provisions for bereavement leave are found in <br /> Article XI of this MOU. <br /> <br /> D. Holidays. Provisions for holiday leave are found in Article IX of this <br /> MOU. <br /> 1. For a recognized City holiday, eight (8) hours, as stated in Article <br /> IX (Holidays), are earned for each holiday.
