i <br />RESOLUTION NO. 2004-28 <br />Koo-08/13/04 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA APPROVING MINOR <br />EXCEPTION NO. 2004-04 TO PERMIT A FENCE THAT <br />EXCEEDS THE FRONT YARD FENCE HEIGHT <br />REQUIREMENT FOR THE PROPERTY LOCATED AT 2422 <br />NORTH SANTIAGO STREET <br />BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Minor Exception No. 2004-04 came before the Zoning Administrator of the <br />City of Santa Ana for a public hearing on August 11, 2004. <br />B. The applicants are requesting approval of Minor Exception No. 2004-04 to <br />create a front yard courtyard area through the construction of a primarily <br />solid stucco wall ranging from 42-inches to 52-inches in height, and capped <br />with barrel tiles within the prevailing front yard setback for the property at <br />2422 North Santiago Street. <br />C. Santa Ana Municipal Code Section 41-638 authorizes the Zoning <br />Administrator to grant a minor exception upon making certain findings. <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />the strict application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this chapter? <br />There are special circumstances applicable to the subject <br />property where the strict interpretation of the zoning <br />ordinance is found to deprive the subject property of <br />privileges not otherwise at variance with the intent and <br />purpose of the provisions of the zoning code. This residence <br />is located within a Historically Significant Area and is eligible <br />for individual listing on the Santa Ana Register of Historical <br />Properties. As such, the architectural style of this property is <br />historically significant and is held to a high standard for <br />development and style.
