AMENDMENT APPLICATION NO. 2003-08, CONDITIONAL USE PERMIT NO. <br />2003-28 AND VARIANCE NO. 2003-07 <br />Filed by Hogle-Ireland for McDonald's Restaurant to allow for a zone change from <br />Commercial Residential (CR) to General Commercial (C2), drive-through window <br />service, and a reduction in the required stacking distance for a new eating establishment <br />located at 3810 South Bristol Street. <br />PUBLISHED IN THE ORANGE COUNTY REPORTER: October 17, 2003 <br />PUBLICLY NOTICED: October 15, 2003 <br />RECOMMENDATION: <br />Recommend that the City Council: <br />1. Deny Amendment Application No. 2003-08. <br />2. Adopt a resolution denying Conditional Use Permit No. 2003-28. <br />3. Adopt a resolution denying Variance No. 2003-07. <br />Verny Carvajal, Associate Planner, presented the staff report and recommendation. <br />Vice Chair Cribb opened the public hearing. <br />Written communication received from McDonald's of a queue analysis from Meghan <br />Macias of LSA Associates for the proposed restaurant. <br />Don Ikeler of McDonald's Corporation spoke in support of the project noting they are <br />disposed to work with staff to obtain the 10 feet needed for the vehicular stacking lane to <br />meet code. <br />Randal Kimoto of Hogle-Ireland, representing applicant, spoke in support of the project <br />and commented on the staff report. <br />Virginia Mangione, owner/operator, spoke in support of the project and noted her history <br />with the city. <br />Robert Henson and Albert Torich spoke in support of the project. <br />Vice Chair Cribb closed the public hearing. <br />Discussion ensued on the vehicular stacking, the cruising on Bristol, the outdoor dining <br />area and hours of operation. <br />Mr. Fregoso noted that if the Commission is inclined to approve, that the item be <br />continued 30 days so that staff may prepare conditions for approval and so that an <br />environmental document may be completed. <br />Motion to continue to November 24, 2003 and work with applicant on <br />recommendation No. 3. <br />MOTION: Sinclair SECOND: Lutz <br />VOTE: AYES: Cribb, De La Torre, Leo, Lutz, Mondo, Sinclair (6) <br />NOES: None (0) <br />ABSENT: Nalle (1) <br />PLANNING COMMISSION MINUTES 4 OCTOBER 27, 2003 <br />
