• <br />RESOLUTION NO.2002-22 <br />Kdo/08/29/02 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING MINOR EXCEPTION <br />NO. 2002-05 FOR THE PROPERTY AT 2100 EAST FOURTH <br />STREET, SUITE 120 <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Minor Exception No 2002-05 came before the Planning Commission of the <br />City of Santa Ana for a public hearing on August 26, 2002. <br />B. Minor Exception No. 2002-05 has been filed with the City of Santa Ana <br />seeking to allow shared parking between uses on the project site located at <br />2100 East Fourth Street, Suite 120. <br />• C. The Zoning Administrator determines that the following findings, which must <br />be established in order to grant a minor exception from the provisions of the <br />Santa Ana Municipal Code, have been established: <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location, or surroundings, <br />the strict application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this chapter. <br />The number of parking spaces provided will be sufficient since <br />the site will be used in a shared manner. The proposed traffic <br />school will operate during off-peak hours, thereby reducing <br />impacts to other uses existing on the project site. <br />2. That the granting of a variance or minor exception is necessary for <br />the preservation and enjoyment of one or more substantial property <br />rights. <br />The granting of the minor exception will allow the traffic school <br />use to operate in a manner that is consistent with the <br />Professional (P) zoning district. <br />• <br />Resolution No. 2002-22 <br />Page 1 of <br />
