• <br />RESOLUTION N0.2002-16 <br />kdo/06/13/02 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING <br />VARIANCE NO. 02-06 FOR THE PROPERTY <br />LOCATED AT 1607-1609 SOUTH SYCAMORE <br />STREET AND 1606 SOUTH MAIN STREET <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Variance No. 2002-06 came before the Planning Commission of the City of <br />Santa Ana for a duly noticed public hearing on June 10, 2002. <br />B. Applicant is requesting a variance from the Santa Ana Municipal Code <br />• Section 41-1347 (a) and (b), in order to allow a reduction in the parking, to <br />allow less than five parking spaces per 1,000 square feet of gross floor area <br />and to count vehicle repair bays at 1607-1609 South Sycamore Street and <br />1606 South Main Street. <br />C. The Planning Commission determines that the following findings, which <br />must be established in order to grant a variance from the provisions of the <br />Santa Ana Municipal Code, have been established: <br />1. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location, or surroundings, <br />the strict application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this chapter. <br />The applicant has operated an automotive body shop along <br />the Main Street property for the past 15 years and has <br />become a fixture along the south Main corridor. The unique <br />nature of the auto body business is such that the strict <br />interpretation of the parking requirements is not appropriate. <br />The auto body business is such that the building is utilized for <br />much of the operation as opposed to automotive repair <br />businesses that require the use of outside parking spaces to <br />• store vehicles.
