That the granting of a variance is necessary for the preservation and <br />enjoyment of one or more substantial property rights. <br />The approval of the variance request is necessary to enjoy the <br />use of the property and in order to accommodate the unique <br />nature of the applicants business, automotive body repair and <br />its operation. The additional floor space on the second floor <br />will be broken down into office and storage, as well as <br />restrooms and a stairwell allowing the applicants successful <br />business to continue to grow. The office and storage uses are <br />considered relatively low in parking impacts and therefore <br />result in a lower parking dependence. Further, the applicant <br />has identified six vehicle repair bays (parking spaces) within <br />the new building. The nature of the auto body business is <br />such that vehicles cannot be left exposed to the elements of <br />Mother Nature and therefore operates differently than other <br />automotive repair businesses. As such, vehicles will not be <br />left outside, occupying open parking spaces. <br />3. That the granting of a variance will not be materially detrimental to the <br />• public welfare or injurious to surrounding property. <br />The granting of a variance, given the unique nature of the <br />business will not be detrimental or injurious to the surrounding <br />properties. Further, the second floor addition with a mixture of <br />office and storage space utilizes uses that require less parking <br />demand than that of automotive repair. <br />4. That the granting of a variance will not adversely affect the General <br />Plan of the City. <br />The requested variance will not adversely affect the General <br />Plan, as it does not have a negative impact on the goals and <br />policies expressed in that document. Specifically, the Land <br />Use Element Goal 2: Promote land uses which enhance the <br />City's economic and fiscal viability; and Goal 3: Preserve and <br />improve the character and integrity of neighborhoods will be <br />supported through the approval of the variance request. <br />D. In accordance with the California Environmental Quality Act, the proposed <br />project is exempt from further review. Categorical Exemption Environmental <br />Review No. 2001-130 will be filed for this project. <br />• Section 2.
