. RESOLUTION NO.00-31 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING CON- <br />DITIONAL USE PERMIT NO. 00-13 TO PERMIT <br />CONSTRUCTION OF A RECYCLING FACIIITY <br />LOCATED AT 1035 EAST FOURTH STREET <br />WHEREAS, Santa Ana Municipal Code Section 41-489.5(0) allows construction of <br />recycling facilities in a M-2 zone district, subject to a conditional use permit; and <br />WHEREAS, Santa Ana Municipal Code Section 41-472.5(a) allows office uses occupying <br />more than 30 percent of the gross floor area of an industrial facility, subject to a conditional use <br />permit; and <br />WHEREAS, this Commission held a public hearing on August 28, 2000, on Conditional <br />Use Permit Application No. 00-13, to allow construction of a recycling facility, located in a M-2 <br />zone, and office uses occupying more than 30 percent of the gross floor area of an industrial facility <br />located at 1035 East Fourth Street. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br />1. The Mitigated Negative Declaration and Monitoring Program for Environmental Review <br />No. ER 00-071 is hereby approved and adopted. <br />2. Based upon the evidence submitted at the abovesaid hearing, this Commission finds and <br />determines as follows: <br />A. Will the proposed use provide a service or facility which will contribute to the general well <br />being of the neighborhood or the community? <br />The proposed recycling facility will contribute to the general well being of the <br />community by providing a service to handle the recycling needs of the community. <br />B. Will the proposed use under the circumstances of the particular case be detrimental to the <br />health, safety, or general welfare of persons residing or working in the vicinity? <br />The recycling facility proposed will meet the city's development and operational <br />requirements for such facilities. A 10-foot block wall is proposed at the perimeter <br />of the property to screen the visual and noise impact to the surrounding properties. <br />C. Will the proposed use adversely affect the present economic stability or future economic <br />development of properties surrounding the area? <br /> <br />
