physical constraints on the site to preclude development. <br />D. The design and improvements of the proposed project will not cause <br />substantial environmental damage or substantially and avoidably <br />injure fish and wildlife or their habitat. <br />No fish or wildlife will be affected by the approval of the map <br />or by the design and improvements of the project. <br />Environmental Review No. 97-173 has been prepared for the <br />project and has identified mitigation measures aimed at <br />substantially reducing any environmental impacts associated <br />with the project to insignificant levels. Pursuant to Title <br />XIV, California Code of Regulations ~ 735.5(c}(1), after <br />considering the record as a whole, there is no evidence that <br />the proposed project will have the potential for any adverse <br />effect on wildlife resources or the habitat upon which the <br />wildlife depends. Therefore, pursuant to Fish and Game Code <br />~ 711.2 and Title XIV, CCR § 735.5(a)(3), the payment of Fish <br />and Game Department filing fees is not required in conjunction <br />with this project. <br />E. The design or improvements of the proposed project will not cause <br />serious public health problems. <br />The projects proposed for this subdivision of land meet or <br />exceed City development standards. As conditioned, future <br />development is required to be in compliance with the <br />applicable industrial or commercial zoning district <br />requirements. <br />F. The design or improvements of the proposed project will not <br />conflict with easements necessary for public access through or use <br />of the property within the proposed project. <br />The applicant will be dedicating 10 feet of property in the <br />form of a street easement for public right-of-way purposes to <br />mitigate impacts of the project. Further, a private street is <br />proposed to be recorded to provide street frontage and access <br />to parcel 1 and the rear of the adjacent property. <br />2. The mitigated negative declaration for Project No. ER 97-173 is <br />hereby approved. <br />3. The Mitigation Monitoring Program attached hereto as Attachment <br />A and incorporated herein by reference is hereby approved and adopted for <br />Project No. ER 97-173. <br />4. Tentative Parcel Map No. 97-156 is hereby approved, as <br />conditioned in Attachment B, attached hereto and incorporated herein. <br />2 <br />
