• GAS: 7/22/99 RESOLUTION NO. 99-27 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SANTA ANA APPROVING VARIANCE NO. 99-06, FOR RELIEF FROM CERTAIN PROVISIONS OF THE SIGN CODE RELATED TO OVERALL HEIGHT, LINEAL FOOTAGE AND SIGN AREA OF A MONUMENT SIGN LOCATED AT 3301 SOUTH BRISTOL STREET WHEREAS, Santa Ana Municipal Code Section 41-638 provides for the granting of a variance from the provisions of the Santa Ana Municipal Code, upon making certain findings; and WHEREAS, this Commission held a public hearing on July 12, 1999, on Variance Application No. 99-06, for relief from the sign code for height, lineal footage and sign area. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISION OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing this Commission finds and determines as follows: A. That because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the zoning ordinance is found to deprive the subject property of privileges not otherwise at variance with the intent and purpose of the provisions of the Municipal Code; The granting of a variance, as conditioned, will allow the monument sign to exceed sign limits, while limiting any additional signs on-site. The approval to allow the monument sign to exceed the maximum height, lineal footage and sign face area, as conditioned, would not jeopardize the intent of the code to reduce sign clutter. B. That the granting of a variance is necessary for the preservation and enjoyment of one or more substantial property rights; As conditioned, the subject site will reduce the number of signs displaying advertisements for the gas station. Approval of the monument sign variation, as conditioned, would not prohibit the identification of the business in an aesthetically appealing manner. The 1
