RESOLUTION NO. 98-26 <br />A RESOLUTION OF THE PLANNING COMMISSION <br />OF THE CITY OF SANTA ANA APPROVING A <br />VARIANCE TO ALLOW A 4,200 SQUARE FOOT <br />OUTDOOR STORAGE AND CUSTOMER PICK UP <br />AREA AND A REDUCTION IN PARKING FOR THE <br />ORCHARD SUPPLY HARDWARE STORE LOCATED <br />AT 1975 EAST SEVENTEENTH STREET <br />WHEREAS, the applicant is seeking a variance from Santa Ana <br />Municipal Code Section 41-425(a), to allow a 4,200 square foot <br />outdoor storage and customer pick up area, and a variance from <br />Santa Ana Municipal Code Section 41-1340, for a 3 percent <br />reduction in parking to accommodate said area. <br />NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid <br />hearing this Commission finds and determines as follows: <br />A. That because of special circumstances applicable to the <br />subject property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is <br />found to deprive the subject property of privileges not otherwise <br />at variance with the intent and purpose of the provisions of this <br />chapter. <br />Due to the location of the business on the rectangular shaped <br />parcel and the nature of the hardware business, an outdoor <br />storage and loading area is critical to the success of the <br />project and can only be achieved by a minor reduction from <br />the Code with regards to parking requirements and is not <br />otherwise at variance with the intent and purpose of this <br />chapter. <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights. <br />Granting of the requested variance would allow Orchard Supply <br />Hardware to compete with other hardware businesses, providing <br />OSH with the enjoyment of substantial property rights as well <br />as the flexibility to meet the intent of the code in a manner <br />that produces no adverse impact to adjacent land uses or <br />properties. <br />
