RESOLUTION NO. 97- }2 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR <br />OF THE CITY OF SANTA ANA APPROVING <br />CONDITIONAL USE PERMIT N0. 97-15 TO <br />ALLOW A TYPE 41 ALCOHOL BEVERAGE CONTROL <br />LICENSE FOR ON-PREMISES CONSUMPTION AT <br />DOS AMIGOS RESTAURANT, LOCATED AT 3701 <br />WEST MCFADDEN AVENUE <br />WHEREAS, Conditional Use Permit No. 97-15 came before the <br />Zoning Administrator for a public hearing on August 27, 1997, to <br />allow a Type 41 Alcohol Beverage Control License for on-premises <br />consumption at Dos Amigos Restaurant, located 3701 West McFadden <br />Avenue; and <br />WHEREAS, following said public hearing, the Zoning <br />Administrator determined to approve Conditional Use Permit No. 97- <br />15, subject to conditions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid hearing <br />the Zoning Administrator finds and determines as follows: <br />A. Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood or <br />community? <br />The sale of beer and wine for on-premise consumption, as <br />conditioned, will provide a service to restaurant patrons <br />by providing the opportunity to consume alcoholic <br />beverages associated with normal dining activities. <br />B. Will the proposed use under the circumstances of the <br />particular case be detrimental to the health, safety or <br />general welfare of persons residing or working in the <br />vicinity? <br />An alcohol license, as conditioned, at the proposed Dos <br />Amigos No. 2 Restaurant is not anticipated to have a <br />detrimental affect to the persons residing or working in <br />the area. The sale of alcohol at the facility will be an <br />ancillary service for the patrons of the restaurant. <br />C. Will the proposed use adversely affect the present economic <br />stability or future economic development of property in the <br />surrounding area? <br />• The ancillary service of on-premise sales of beer and <br />1 <br />
