Mr. Watanabe responded yes. <br />Commissioner Mondo asked if condition number 2 applied to 24 hour operations. <br />Mr. Kenneth Adams, Planning Manager, responded that for this particular case <br />condition number 2 would not apply. <br />Commissioner Nalle asked if Police Department condition number 1 was the same <br />as other after hour operations. <br />Mr. McCoy responded that the it was a standard condition of approval. <br />Commissioner Nalle moved to approve Conditional Use Permit No. 96-17. The <br />motion was seconded by Commissioner Doughty. <br />Commissioner Mondo expressed opposition to approving the 24 hour request when <br />the applicant did not attend to operate the restaurant for 24 hours. <br />AYES: Brown, Nalle, Doughty, Pedroza and Segura <br />NOES: Mondo <br />ABSENT: Oliver <br />3. Comments from the Planning Manager. (Kenneth Adams) <br />Ms. Yolanda Pena, Police Department, discussed the Department's concerns <br />regarding an investigation held for the Galaxy Theater. She recommended that <br />Planning Commission review the conditions of approval at an upcoming <br />Commission meeting. In addition, she added that the Monday night cover <br />charge was not consistent with the approved conditional use. <br />Mr. Gary Sheatz, Deputy City Attorney, mentioned another recent court case <br />involving the City. <br />Commissioner Mondo asked the status of the Roxbury's conditional use permit. <br />Mr. Adams responded that a 21 day notice for revocation had begun. <br />Commissioner Mondo asked if there were any food services at Roxbury's night <br />club. <br />Ms. Pena indicated that the entire first floor of food services had been <br />completely dismantled and the floor was being used for entertainment <br />purposes. <br />Commissioner Mondo requested staff to verify the conditions of approval for <br />the Galaxy Theater as to whether the theater had been issued a dancing <br />permit. <br />Commissioner Nalle requested staff to verify if there were any other problems <br />associated with the site. <br />PLANNING COMMISSION MINUTES 5 TUNE 24, 1996 <br />
