PUBLIC BEARINGS <br />ROLL CALL: The Regular Meeting of the Santa Ana Planning Commission was called to <br />order and conducted by Chairman Mondo in the City Council Chambers, 22 civic Center <br />Plaza, Santa Ana, California. Roll call was answered by Chairman Mondo and <br />Commissioners Brown, Oliver, Doughty, Pedroza, Segura and Diana Lopez, student <br />representative from Valley Bigh School. Also in attendance were: Kenneth Adams, <br />Planning Manager; Richard Lay, Assistant City Attorney; Gary Sheet z, Deputy City <br />Attorney; Jeffry Rice, Senior Planner; Tom Childress, Associate Planner; Pam Lucado, <br />Public Works Agency, Mike McCoy, Police Department; and Sharon McCain-Johnson, <br />Recording Secretary. <br />' PLEDGE OF ALLEGIANCE TO TAE FLAG: The Pledge of Allegiance was led by Troop 22 of <br />the Boy Scouts <br />PROCEDURAL RVLES: The procedural rules for the session were read by Chairman Mondo. <br />PUBLIC HEARINOS• <br />1. GENERAL PLAN AMENDMENT NO. 96-001 (Jeffry Rice) <br />Filed by Miller Construction Company to change the land use designation from <br />Medium Density Residential-15 dwelling unite per acre to General Business <br />District-0.5 on Fourth Street from French Street to Garfield Street. <br />LEGAL NOTICED: January 13, 1996 <br />PUBLIC NOTICED: January 12, 1996 <br />RECOMMENDATIONi <br />1. Recommend that the City Council adopt a resolution approving General <br />Plan Amendment No. 96-001 to amend the Land Use Element of the General <br />Plan; and <br />2. Recommend that the City council approve Mitigated Negative Declaration <br />ER No. 95-118. <br />Mr. Jeffry Rice, Senior Planner, provided a brief overview of the applicant's <br />request to change the land use designation in order to construct a full <br />service grocery store. Mr. Rice indicated that a mitigated negative <br />' declaration had been prepared and mitigation measures would be implemented <br />during the construction of the project. The proposed grocery store meets all <br />other code requirements and staff recommends approval of the project. <br />Mr. Tim Miller, representing Northgate Market, thanked the Commission for <br />their support for the previous Northgate Market proposal. <br />Chairman Mondo informed Mr. Miller if he planned to sell alcoholic beverages <br />in the future that he should file a conditional use permit in addition to his <br />application at this time. <br />Mr. Miller indicated that the applicant did not intend to sell alcoholic <br />beverages. <br />Commissioner BYOwn moved to approve General Plan Amendment No. 96-001. The <br />motion was seconded by Commissioner Doughty. <br />AYES: Mondo, Brown, Oliver, Doughty, Pedroza, and Segura <br />NOES: None <br />ABSENT: Nalle <br />2. CONDITIONAL USE PERMIT NO. 95-38 (Tom Childress) <br />Filed by Ma. Sor Kann Tang to allow after hour operations every day at an <br />established donut shop located at 2102 South Main Street, Suite A. <br />LEGAL NOTICED: January 13, 1996 <br />PUBLIC NOTICED: January 12, 1996 <br />RECOMMENDATION: <br />' Approve Conditional Use Permit No. 95-38 as conditioned by staff and adopt <br />the findings as submitted by staff. <br />Mr. Tom Childress, Associate Planner, provided an overview of the staff <br />report and indicated that the applicant was requesting to operate a donut <br />shop 24 hours every day, seven days a week. Staff reviewed the application <br />and determined that the extended hours of operation would not create any <br />negative impacts and recommends approval of the request. <br />Commissioner Doughty asked if there had been any crime in the area. <br />Mr. Mike McCoy, indicated that there had been one disturbing the peace <br />reported in 1985; one petty theft report; and one other crime report made. <br />PLANNING COMMISSION MINUTES 2 IANUARY 22, 1996 <br />
