CONDITIONAL USE PERMIT NO 95-23 (Larry Yenglin) <br />Filed by Mr. Gerald O'Connell to operate a 24 hour restaurant (Norm's) <br />located at 102 East Seventeenth Street in the General Commercial (C2) <br />zoning district. <br />LEGAL NOTICE PUBLISHED: October 29, 1995 <br />PUBLIC NOTICES MAILED: October 31, 1995 <br />RECOIY~NDATION: <br />Approve Conditional Use Pernit No. 95-23 as conditioned by staff and adopt <br />the findings as submitted by staff. <br />' Mr. Larry Yenglin, Associate Planner, indicated the applicant, Norm's <br />Restaurant, is requesting to continue operations between the hours of <br />12:00 a.m. and 5:00 a.m. The restaurant is a full service restaurant; <br />although it is located in a high crime area, staff had not received any <br />complaints regarding the restaurant and ie in support of the project. <br />Commissioner Doughty inquired regarding the types of crimes; how Norm's <br />measured up to other restaurants; and if it were not opened for 24 hours <br />would the crime rate decrease. <br />In response, Mr. Mike McCoy stated that there had been 10 reported <br />incidents in 1995 mostly disturbing the peace and a few auto burglaries. <br />The restaurant measured 11th out of 102 in crime and if Norm's was not <br />opened for 24 hours, the crime rate would likely decline. <br />Mr. Terry O' Connell briefly indicated that the crime issues had been <br />addressed and he reviewed the conditions and had no objections. <br />Commissioner Doughty commended the newly renovated restaurant and asked if <br />there were patrols the parking lot area at night. <br />Mr. O'Connell indicated that staff makes periodic visits to the parking <br />lot. <br />Commissioner Doughty moved to approve Conditional Use Permit No. 95-23. <br />The motion was seconded by Commissioner Nalle. <br />AYES: Mondo, Brown, Doughty, Nalle, Pedroza, and Segura <br />NOES: None <br />' ABSENT: Oliver <br />4. AMENDMENT APPLICATION NO. 95-8 (Vince Fregoso) <br />Filed by Veronica Ruiz to change the zoning of the subject property <br />located at 1326 North Logan Street from Two-Family Residential (R2) to <br />Light Industrial (M1) in order to construct an auto repair facility. <br />LEGAL NOTICE PUBLISHED: October 29, 1995 <br />PUBLIC-NOTICES MAILED: October 31, 1995 <br />Recommend that the City Council deny Amendment Application No. 95-8. <br />Mr. Vince Fregoso, Associate Planner, briefly indicated that the applicant <br />was requesting to change the zoning designation of three parcels from Two- <br />Family Residential to Light Industrial and to construct an automobile <br />repair facility. In summation of the history of the project, Mr. Fregoso <br />stated the project had been before the Commission and City Council several <br />times in 1994 and the request was to allow an automotive salvage yard. <br />The project was denied due to the negative impacts to the adjacent <br />residential neighborhood. <br />City Council directed staff to work with the applicant and the <br />neighborhood to determine various alternatives for .the project. No <br />additional alternatives could be agreed upon by the parties so the <br />applicant requested and was granted an indefinite continuance. In <br />addition, staff feels that the project would negatively impact the <br />adjacent residential uses and does not support the project. <br />Me. Veronica Ruiz, applicant, displayed a slide presentation and briefly <br />stated that previously she had requested an auto salvage yard. This new <br />proposal unlike the previous one would be an auto repair yard. The <br />proposed project would be a smaller business; would not require tow trucks <br />which would reduce the noise level for the adjacent residents; and would <br />benefit the community. <br />PLANNPIG COMNl55ION MQJII:ES Naember 13, 1995 <br />4 <br />
