PUBLIC NEARINGS <br />PUBLIC NEARINGS <br />ROLL CALL: The Regular Meeting of the Santa Ana Planning Commission was called <br />to order and conducted by Chairman Mondo in the City Council Chambers, 22 Civic <br />Center Plaza, Santa Ana, California. In attendance were: Robyn Uptegraff, <br />Executive Director; Jeffry Rice, Acting Planning Manager; other City staff in <br />attendance: Charles View, Senior Planner; Sergio Klotz, Associate Planner; Vince <br />Fregoso, Associate Planner; Bill Apple, Assistant Planner II; Pam Lucado, Public <br />Works Agency, Mike McCoy, Police Department; Sharon McCain-Johnson, Recording <br />Secretary; and Valley HighSchool student representatives Diana Lopez and Martha <br />Brito. <br />' PLEDGE OF ALLEGIANCE TO THE FLAG: The Pledge of Allegiance was led by Chairman <br />Mondo. <br />PROCEDURAL RULES: The procedural rules for the session were read by Chairman <br />Mondo. <br />PUBLIC HEARINGSā¢ <br />I. ZONING ORDINANCE AMENDMENT NO. 94-4. (Sergio Klotz) <br />Filed by the City of Santa Ana to revise the allowable uses and <br />development regulations in the City's industrial zoning districts. <br />(Continued by the Planning Commission October 9, 1995 to October 23, 1995) <br />Recommend that the City Council approve Zoning Ordinance Amendment No. 94- <br />4. <br />Commissioner Nalle moved to continue Zoning Ordinance Amendment No. 94-4 <br />to November 13, 1995. The motion was seconded by Commissioner Brown. <br />AYES: Mondo, Brown, Oliver, Nalle, and Segura <br />NOES: None <br />ABSENT: Doughty and Pedroza <br />Z. GENERAL PLAN AMENDMENT NO. 95-07: AMENDMENT APPLICATION NO. 95-06: AND <br />CONDITIONAL USE PERMIT NO. 95-21. (Bill Apple) <br />' Filed by Mr. Ted Vandling to change the General Plan and zoning to a <br />Commercial designation and allow a drive-through service at a restaurant <br />located at 1325-1331 East Seventeenth Street. <br />(Continued by the Planning Commission October 9, 1995 to October 23, 1995) <br />LEGAL NOTICE: September 28, 1995 <br />PUBLIC NOTICES MAILED: September 27, 1995 <br />1. Recommend that the City Council adopt a resolution approving General <br />Plan Amendment No. 95-07 to amend the Land Use Element of the <br />General Plan; <br />2. Recommend that the City Council adopt an ordinance approving <br />Amendment Application No. 95-06; and <br />3. Approve Conditional Use Permit No. 95-21 as conditioned by staff and <br />adopt the findings as submitted by staff. <br />Mr. Bi11 Apple, Assistant Planner II indicated briefly that the item was <br />continued to resolve issues related to landscaping and hours of operation. <br />Mr. Apple informed the Commission that the conditions of approval had been <br />revised to limit the hours of operation for the drive-through service and <br />outdoor seating area and an eight foot block had to be provided around the <br />perimeter of the property. <br />Mr. David Ewing, representing the applicant, indicated that the applicant <br />agreed to provide the eight foot block wall but he felt that the spikes <br />would be an aesthetic hindrance. <br />Mr. Philip Dolaway, Willie Cunningham, and Ray Ybarra, residents of the <br />neighborhood, reiterated their concerns regarding noise, security, and the <br />impacts of the project to the neighborhood. <br />Commissioner Oliver moved to approve General Plan Amendment No. 95-07, <br />Amendment Application No. 95-06, and Conditional Use Permit No. 95-21. In <br />addition, he recommended amending the conditions to: 1) limit the hours <br />of drive-through service to 9:00 p.m.; 2) not require the applicant to <br />provide spikes for the outdoor seating area fence; and 3) review the <br />project in six months.
