Commissioner Oliver inquired about the closure hours recommended by staff <br />and the nronoaed liahtino and its eff seta nn thn ncinhhnrhnnA <br />Commissioner Oliver inquired about the closure hours recommended by staff <br />and the proposed lighting and its effects on the neighborhood. <br />Mr. Apple indicated staff recommended that the drive-through lane be open <br />between 7:00 a.m. to 10:00 p.m. due to noise concerns for the <br />neighborhood, however, the restaurant hours of operation could be 5:00 <br />a.m. to 12:00 a.m. <br /> Mr. McCoy indicated that the perimeter of the property would have the <br /> maximum 111umination of lighting but the applicant would be required to <br /> reduce 3/4 of the required maximum lighting which would trespass into the <br /> residential areas. <br />' Commissioner Oliver asked if any discussions were held with the residents <br />regarding the project. <br /> Mr. Apple indicated that there was one discussion with a resident and he <br /> requested that the height of the wall be increased due to crime and <br /> loitering concerns. <br /> Mr. David Ewing representing the applicant, indicated that the required <br /> height of the wall was six feet, however, he felt the applicant would <br /> comply with the residents request to raise the height of the wall. <br /> The following persona supported neighborhood improvements but expressed <br /> concerns regarding the wall height and the drive-through lane increasing <br /> noise, loitering, and crime. It was also expressed that the restaurant <br /> would increase odor, smoke, and grease in the neighborhood environment. <br /> Mr. Willie Cunningham <br /> Mr. Philip Dolaway <br /> Mr. Ray Ybarra <br /> Mr. Winston Cunningham <br /> Commissioner Brown noted that the staff report indicated there would be an <br /> outside eating area and asked if customers would be able to eat in that <br /> area until 12:00 a.m. <br />Mr. Apple responded yes. <br />Commissioner Nalle moved to approve General Plan Amendment No. 95-07 and <br />Amendment Application No. 95-6. The motion failed due to the lack of a <br />second. <br />' Commissioner Oliver stated that development of the vacant site would <br />improve the area, however, the concerns of the neighborhood regarding the <br />height of the wall, odors and security issues needed to be addressed. <br />Commissioner Brown expressed concerns regarding the outside eating area <br />and loitering. <br />Commissioner Nalle noted that the height of the wall should be increased <br />to eight feet. <br />Commissioner Oliver asked if trees would mitigate noise and light and also <br />commented that the drive-through lane closure hours be modified to 8:00 <br />p.m. <br />Mr. Adams stated that trees would mitigate noise and light, however, it <br />raised security concerns for the Police Department. He suggested that the <br />Commission continue the item for two weeks to discuss the wall height and <br />landscaping options. <br />Commissioner Oliver concurred with the continuance and stated his <br />particular concerns were noise and the height of the wall. <br />Commissioner Brown moved to continue the item for two weeks.
