Motion to approve Environmental Review No. 97-126 and Site Plan Review No. 98-04. <br /> <br /> <br /> <br />E. <br />F. <br />Motion to approve Environmental Review No. 97-126 and Site Plan Review No. 98-04. <br />MOTION: Solorio SECOND: McDowell <br />AYES: Verino, MacDowell, Doughty, Nalle, Cribb, and Solorio <br />NOES: None <br />ABSENT: Mondo <br />ABSTAIN: None <br />ZONING ORDINANCE AMENDMENT NO. 98-OS <br />Filed by the City of Santa Ana to adopt citywide policies for exterior telephones requiring all exterior <br />telephones be permitted with a land use certificate. <br />LEGALLY NOTICED: August 30, 1998 <br />Mr. Kenneth Adams, Planning Manager, displayed slides of public telephone sites in the City, <br />presented the staff report and recommendation. <br />Mr. Reed Royalty, representing Pacific Bell, indicated that Pacific Bell understood and shared staff's <br />desire to eliminate unsightly public phones and had no objection to staff doing so. But expressed <br />concerns with 1) limiting the conduit to six inches and recommended that the Commission allow eight <br />feet of conduit; 2) requiring all owners of existing public pay phones to pay a fee of $150 and <br />recommended that the Commission only require the fee for the new phones; and 3) staffs <br />enforcement strategy. <br />After further comments and questions, the Commission requested clarification from staff as to <br />whether or not existing pay phones would be required to pay the $150 fee; how the $150 fee was <br />determined; what the estimated time period was for the phones to become into compliance; and if <br />staff had researched how other cities regulated pay phones. <br />Mr. Adams responded that all existing and future pay phones would he required to pay the $150 fee; <br />staff researched the processing time for the pay phones and determined that $225 would cover the <br />processing of the applications but decided to reduce the tee to $150; and there was no research done <br />as to how other cities handled the regulation of the pay phones. <br />Motion to continue Zoning Ordinance Amendment No. 98-OS to September 14, 1998 and directed <br />staff to consider an incentive program for code compliance of pay phones and to revisit the <br />proposed $150 fee. <br />MOTION: Mondo <br />SECOND: Doughty <br />AYES: Verino, MacDowell, Mondo, Doughty, Nalle, Cribb, and Solorio <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Recess. <br />The afternoon session recessed at 7:10 p.m. <br />2 <br />
