PUSLIC HEARINGS <br />PUSLIC HEARINGS <br />ROLL CALL <br />PLEDGE OF ALLEGIANCE TO THE FLAG <br />PROCEDURAL RULES <br />7:00 p.m. <br />1. CONDITIONAL USE PERMIT NO. 98-07 (Sergio Klotz) <br />Filed by Ms. Sonia Johnson to allow the development of a recycling facility located at 1011 East Pine <br />' Street in the Light Industrial (M1) zoning district. <br />(Continued by the Planning Commission July 13, 1998 to September I4, 1998) <br />LEGALLY NOTICED: June 7, 1998 <br />PUBLICLY NOTICED: June 9, 1998 <br />RECOMMENDATION: <br />Mr. Sergio Klotz, Associate Planner, presented staff report and recommendation. <br />Mr. Norm Johnson, representing the applicant, displayed pictures of the site, discussed with the <br />Commission the different types of fencing that would assist in mitigating noise levels and the prices <br />for the different types of fencing, and requested that the Commission allow the installation of steel <br />fencing at the site instead of the required block wall. <br />Ms. Isabel Betran, resident, indicated that she did not have any problems with the proposed project <br />but she expressed concern with the current and future traftic problems; requested that the Commission <br />require the applicant to obtain a block wall instead of the requested steel fence; and she stressed the <br />fact that the business was located in a residential area and the block wall would assist in maintaining <br />the residential area. <br />The following public members spoke in opposition to the project. It was expressed that approval of <br />' the abandonments would bring hardship to the adjacent property owners; would eliminate access to <br />their property; and the property owners requested that the Commission suggest that the applicant sell <br />a portion of their property to the adjacent business. <br />John Nettel <br />John Ulicki <br />Mr. Adams informed the Commission that staff believed it was a private matter and cautioned the <br />Commission regarding getting into private matters out of their jurisdiction. <br />Motion to approve Conditional Use Permit No. 98-07 as conditioned. <br />MOTION: MacDowell SECOND: Mondo <br />After further Commission comments and discussion regarding conditioning the project for the <br />applicant to sell the property, and the revocation of the conditional use permits if all conditions were <br />not complied with in completion, the Commission motioned to continue the project. <br />Substitute motion to continue Conditional Use Permit No. 98-07 to encourage the property owner <br />and the applicant to arrive at an equitable agreement as to the unproved access onto the Nettel and <br />Ulieki property. <br />0 <br />MOTION: Nalle <br />SECOND: Doughty <br />AYES: Verino, MacDowell, Mondo, Doughty, Nalle, Cribb, and Solorio <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />PLANNING COMMISSION MINUTES j Sepmmber l4, 1998 <br />
