5 <br />5 <br /> <br />4. <br />5. <br />6. <br />SMJ <br />'/ <br />a <br />AMENDMENT APPLICATION NO. 97-02 AND CONDITIONAL USE PERMIT NO. 97-11 <br />/Thnmaa f`hi lA.-vao~ <br />AMENDMENT APPLICATION NO. 97-02 AND CONDITIONAL USE PERMIT NO. 97-11 <br />(Thomas Childress) <br />Filed by Mr. John Killen and Mr. Raymund Villanueya to change from the <br />Commercial Residential (CR) zone to Community Commercial (C1) zoning district <br />located at 3305-3365 South Bristol and to allow construction of an In-N-Out <br />Burger restaurant located at 3361 South Bristol Street. <br />LEGAL NOTICED: April 27, 1997 <br />PUBLIC NOTICED: May 2, 1997 <br />RECOMMENDATION: <br />1. Recommend that the City Council adopt an ordinance approving Amendment <br />Application No. 97-02. <br />2. Approve Conditional Use Permit No. 97-11 as conditioned and adopt the <br />findings as submitted by staff. <br />Mr. Thomas Childress, Associate Planner, provided an overview of the staff <br />report and recommendation. <br />Commissioner MacDOwell expressed concern regarding the noise from the drive- <br />through speaker box intruding into the adjacent neighborhood. <br />Mr. Childress responded that the only residential property to the proposed <br />restaurant was located across Bristol Street and staff did not believe noise <br />from the establishment would become a problem or intrude into the <br />neighborhood. <br />Mr. John Killen, applicant, expressed his appreciation to staff and stated <br />that he had reviewed the staff report and agreed with the conditions of <br />approval. <br />Hotion to approve Amendment Application No. 97-02 and Conditional Use Permit <br />No. 97-11. <br />MOTION: Hanna SECOND: Doughty <br />AYES: Nalle, Oliver, Doughty, Verino, Hanna, and MacDOwell <br />NOES: None <br />ABSENT: None <br />ABSTAINED: Mondo <br />ORAL COMMUNICATIONS - COMMENTS FROM THE PUBLIC. <br />fFOr matters not previously listed on the Aaeadal <br />There were no oral comments. <br />EBCUSE OF ABSENCES. <br />There were no absences. <br />ADJOURNMENT. <br />The meeting adjourned at 10:00 p.m. <br />l~~ <br />Commission <br />PLANNING COMMISSION MINUTES 5 MAY 12, 1997 <br />
