3. ZONING ORDINANCE AMENDMENT NO. 00-02, CONDITIONAL USE PERMIT NO. 00-02, AND MINOR EXCEPTION NO.00-02 Filed by the Roman Catholic Bishop of Orange to amend the Harbor Specific Plan in order to permit a new church and to share parking with an exiting hall located at 285 South Harbor Boulevard in Specific Development 2. PUBLISHED IN THE REGISTER: March 31, 2000 NOTICED IN NOTICED: March 31, 2000 ' RECOMMENDATION: 1. Recommend that the City Council approve and certify the Negative Declaration for Environmental Review No. 99-179. 2. Recommend that the City Council adopt an ordinance approving Zoning Ordinance Amendment No. 00-02. 3. Recommend that the City Council adopt a resolution approving Conditional Use Permit No. 00-02 as conditioned. 4. Recommend that the City Council adopt a resolution approving Minor Exception No. 00-02. Mc Jeffry Rice, Principal Planner, provided an overview of the applicant's request, presented the staff report and recommendation. Commissioner Cribb inquired regarding the project affecting the entertainment zone for Harbor Boulevard. Mr. Rice responded that the zoning ordinance amendment would allow church uses subject to a conditional use permit. Commissioner Solorio asked if the surrounding property owners were informed of the proposed project and if any correspondence had been received. Mr. Rice stated that there had been several meetings with the public and no correspondence had been received. ' Mr. Frank McNamara spoke in support of the project and provided an overview of the church activities, vehicular traffic and pazking access. Mr. Dave Lopez, Riverview West Neighborhood Association, stated that the association had a recent meeting and that approximately 75 percent of the neighborhood was in favor of the project with the other 25 percent non supportive. He further expressed that several local church sites in the City had trash problems and illegal sales activities. He requested that conditions address these issues. Mr. Bri Arri, introduced himself as the Pastor of the Church, and assured the Commission that the church site would be always in a clean state. He further provided an overview of some of the operations at the church and commented that he encouraged fellowship and activities for children during and after mass. Commissioner Cribb asked if the landscaping at the site would be mature and consist of palm trees as depicted on the renderings. Mc Jeffry Rice responded that palm trees were not allowed in the pazking lot areas per the Santa Ana Municipal Code, however, the landscaping proposed met or exceeded the code requirements. Commissioner Cribb further commented that he believed when renderings provided illustrations of mature landscaping and the intention was not to place mature landscaping it was a misrepresentation and that in the future he would prefer renderings display the accurate size and type of landscaping. Motion to recommend that the City Council: 1) approve and certify the Negative Declaration for Environmental Review No. 99-179 with modij"cations to the construction hours on Saturday(s); 2) adopt ' an ordinance approving Zoning Ordinance Amendment No. 00.02; 3) adopt a resolution approving Conditional Use Permit with modifcations to the conditions of approval; and 4) adopt a resolution approving Minor Exception No. 00-00 with madifccations to the conditions of approval.
