At the hearing the payphone was not an issue, however, the <br />applicant has been made aware of an existing contract for the payphone to remain at the location <br />Ms. Joyce Amerson, Public Works Agency, informed the Commission that if the payphone was in the public <br />right-of--way, staff would take action to remove the payphone. <br />Mr. Timothy Thomas, applicant, informed the Commission that he would like to see the payphone removed <br />from its location, however, he was not involved in the decision of the contract. <br />' Motion to set Conditional Use Permit No. 99-20 for public hearing December 13, 1999. <br />MOTION: Mondo SECONDED: Nalle <br />APES: Verino, Mondo, Nalle, Doughty, Solorio, Cribb, and Richardson <br />OPPOSED: None <br />ABSENT: None <br />ABSTAINED: None <br />I. Comments from the Executive Director. <br />Ms. Robyn Uptegraff, Executive Director, informed the Commission that the City was in litigation for <br />acquisition for the bus yard; a hearing was set on November 18, 1999, and there was a Court order for OCTA <br />not to proceed with the project until the hearing date. In addition, she informed the Commission that there <br />would be a meeting to discuss the rail project on December 13, 1999. <br />G. Comments from the Planning Manager and staff. <br />There were no comments. <br />H. Comments from the Planning Commission. <br />' Commissioner Solorio requested a discussion regarding pedestrian safety; and asked the status of the Youth <br />Services and Open Space Element. Ms. Uptegraff informed the Commission that staff was expecting to bring <br />the Element forward after the first of the year. <br />Commissioner Mondo expressed concern regarding the doors entering into the building and the lack of signs <br />informing and directing the public where to enter the Ross Annex for the Commission meetings and requested <br />staff address the issue. <br />Commissioner Richardson complimented the Public Works Agency on the completion of the parking structure <br />at the train station; informed staff that Santa Ana Boulevard at Spurgeon had a severe ripple in the street and <br />was in need of repair; and expressed concern regarding the recent carnival held at Memorial Park and asked <br />why commercial carnivals were being held at the parks. <br />Commissioner Cribb requested that staff agendize study sessions regarding entryways into the City, <br />landscaping requirements, public safety, signage on the 55 freeway, and rooftops of Pennway. <br />I.
